Publication A Comparative Study On Copyright Protection For Digital Works In Palestine And Uk(World Academy of Islamic Management (WAIM), 2024) ;Mohammed M.M Qtait ;Mohammed Nizam Awang ;Haliza A. ShukorIntan Nadia Ghulam khanThe direct influence of technology on copyright was the main impetus for the development of copyright legislation. Because the Palestine Copyright Act of 1911 is out of date, it does not address the technological advancements in copyright field. The state of Palestine drafted a proposal for new copyright legislation that governs the copyright protection for digital works, but owing to the suspension of the parliament, it has not been enacted. This research aims to examine issues of the meaning of digital copyright works, the requirements for copyright protection for digital works, copyright protection for digital works that described in the Palestine Copyright Act of 1911, the Palestine Copyright Draft (Proposal) 2013, and UK CDPA 1988 in order to strengthen a substantial component of the law in Palestine. The comparative research approach was used, along with a functional method. The findings of this research indicate that the Palestine Copyright Act 1911 lacks copyright protection for digital works, while the Palestine Copyright Draft 2013 governs this issue to some extent. This study suggests that before the copyright draft is approved, changes need to be made, especially in regard to the issue of copyright protection requirements. - Some of the metrics are blocked by yourconsent settings

Shukor ;Intan Nadia Ghulam KhanHasnizam HashimKontrak lesen ialah satu bentuk kontrak yang dibuat secara bertulis berdasarkan pada terma yang dipersetujui antara pihak-pihak yang berkontrak berkaitan dengan pelesenan paten. Kontrak lesen merupakan salah satu cara eksploitasi harta intelek yang dibuat bagi tujuan mengkomersialkan reka cipta yang telah dipatenkan. Kajian lepas mendapati bahawa salah guna hak paten oleh pihak-pihak yang berkontrak boleh berlaku melalui terma-terma yang dimasukkan dalam kontrak lesen tersebut. Oleh itu, makalah ini bertujuan untuk mengenal pasti dan menganalisis peruntukan undang-undang yang mengawal terma dalam kontrak lesen. Bagi mencapai objektif tersebut, makalah ini mengguna pakai kaedah kepustakaan dan analisis dokumen perundangan yang berkaitan seperti akta, kes yang telah diputuskan oleh Mahkamah, buku, dan jurnal. Hasil kajian menunjukkan terdapat peruntukan undang-undang di Malaysia yang mengawal terma yang dimasukkan dalam kontrak pelesenan paten. Pengenalan Undang-Undang Persaingan di Malaysia selaras dengan hasrat komuniti ekonomi ASEAN yang bermatlamat untuk menjadikan ASEAN sebagai rantau yang berdaya saing di peringkat global. Perbincangan yang terkandung di dalam buku ini menerangkan secara terperinci pemakaian Undang-Undang Persaingan di Malaysia seperti yang terkandung di dalam Akta Persaingan 2010, Akta Suruhanjaya Persaingan 2010 dan juga garis-garis panduan yang telah disediakan oleh pihak Suruhanjaya Persaingan Malaysia. ShukorIntan Nadia Ghulam KhanCopyright exceptions for teaching and research purposes have turned into a significant issue for achieving a balance between the copyright owner and copyright users. The regulation of this issue is reflected in the Copyright Acts 1911 and 1987 for Palestine and Malaysia, respectively. The Palestine Copyright Act 1911 dismisses teaching and research copyright exceptions in detail and has not been amended since 1911; signifying a huge setback in regulating this issue and the pressing need to improvise the Act in order to achieve a balance between the copyright owner and copyright users. The present study has looked into the teaching and research exceptions detailed in the Palestine Copyright Act 1911 with the aim of suggesting improvements in the Act. The comparative research approach was used, along with a functional method. The findings revealed that the Malaysia Copyright Act 1987 offers several provisions in regulating the teaching and research exceptions based on a fair dealing rule, while the Palestine Copyright Act 1911 lacked provisions in regulating these exceptions despite its fair dealing principle. Publication Exclusion To Prohibition Of Anti-competitive Conduct On The Legislative Ground In Malaysia: A Cross-sectoral Analysis(Sciendo, 2022) ;Haniff Ahamat ;Haliza A. Shukor ;Aiman Danial Dazuki ;Khoo Khai Hau ;Hanny Zurina HamzahAzlanor RahmadIn Malaysia, its competition law (Competition Act 2010) excludes commercial activities from prohibitions on the ground that they are in pursuant to an order to comply with a legislative requirement. While this type of exclusion is present in other jurisdictions including the European Union (EU) and Singapore, there is slight difference in legislative wording in the Malaysian law leading to narrower scope of exclusion. Hence this article analysesthe application of the exclusion in specific sectors in Malaysia. Usingtheblack letter approach to legal research, the analysis inpaper finds that only limited sectors namely professional services fulfil the criteria, while the other sectors, though have legislation that provides for conduct which could be acted upon, such as price fixing, are short of 1007BALTICJOURNALOFLAW&POLITICSISSN2029-0454VOLUME15,NUMBER72022such an order. This creates false impressionthat certain activities are shielded merely by being mentioned in a statutewhereas a gazettedorder from the state to perform them is absent. Mutakhir ini, terma nikah sindiket telah banyak digunakan secara langsung dalam kontek perkahwinan yang mana ia memerlukan penjelasan terperinci tentang pendefiniisian nikah sindiket. Hukum Syarak yang berkaitan dengan munakahat atau perkahwinan perlu diterjemahkan dalam bentuk proses dan prosedur yang teratur sebagai suatu garis panduan kepada masyarakat. Di Malaysia, selari dengan bidang kuasa yang diperuntukkan oleh Perlembangan Persekutuan, tanggung jawab bagi mewujudkan proses dan prosedur ini digalas oleh Jabatan Agama Islam dan juga Mahkamah Syariah bagi negeri-negeri. Namun begitu, walaupun terdapat pelbagai khidmat berkaitan proses pernikahan dan juga perkhidmatan sokongan berkaitan diberikan, masih wujud pihak-pihak yang tidak mematuhi proses dan prosedur tersebut sehingga menyukarkan banyak pihak lain terutamanya agensi agama berkaitan. Jabatan Agama Islam dan Mahkamah Syariah hanya akan dirujuk apabila pihak-pihak ini berhadapan dengan masalah yang tidak mampu mereka selesaikan. Justeru, kertas kerja yang menggunakan metode kualitatif ini akan menganalisis tentang sejauhmanakah prosedur pernikahan sedia ada mampu untuk mendepani isu-isu dan permasalahanpermasalahan berkaitan perkahwinan yang tidak mengikut prosedur atau undang-undang Keluarga Islam di Malaysia. Ia juga berfungsi sebagai sumber tenaga manusia yang akan mengisi kehidupan masyarakat kemudian hari dan menentukan bentuk kehidupan tersebut. Di samping itu, keluarga juga berfungsi sebagai tempat membina peradaban dan kebudayaan masyarakat serta perkembangannya. Terdapat lima asas institusi kekeluargaan dalam Islam yang merangkumi, akidah, syarat, akhlak, cinta dan kasih sayang, persamaan, keadilan dan jaminan sosial. Namun begitu, krisis rumahtangga masih banyak berlaku di kalangan masyarakat Islam. Antara punca-punca krisis rumah tangga ialah pengetahuan dan pendidikan agama yang tidak sempurna, tekanan bebanan kerja, sikap pasangan, campur tangan pihak luar, masalah ekonomi dan sebagainya. Pembangunan Undang-Undang Persaingan di Malaysia ialah selaras dengan Pelan Tindakan Ekonomi ASEAN yang ditandatangani pada tahun 2007 yang bertujuan menggalakkan ahli negara-negara ASEAN memperkenalkan Undang-undang Persaingan domestik di negara masing-masing menjelang tahun 2015 bagi menjadikan ASEAN sebagai rantau yang berdaya saing. ShukorIzawati WookSolid waste is one of the major environmental problems that is gaining attention in most countries in the world. The increase in solid waste generation as the world is facing the Covid-19 Pandemic has posed new challenges for many countries including Malaysia in solid waste management. Failure to manage solid waste in facing this pandemic will inevitably cause catastrophe and adverse effects on public safety and health as well as the environment. Every household can produce hazardous solid waste such as contaminated face masks or other household solid wastes during the pandemic that must be managed carefully and effectively. Among the challenges in solid waste management at the time of pandemic is the increase in the amount of mixed waste including infectious waste due to the low level of waste separation at source and the increase in the amount of plastic waste. In this regard, the existing laws related to solid waste management in Malaysia need to be streamlined so that solid waste management can be made more effective while minimizing the risk of pollution and threats to public health. From another angle, the Shariah has emphasized on the importance and responsibility of preserving and managing the environment, including aspects of solid waste management in order to safeguard human life and prevent damage. The methods of literature review and interviews have been employed in this article to discuss household solid waste management during the Covid-19 pandemic from the Malaysian legal perspective and related Shariah principles. Publication Shariah Criminal Offences In Syndicate Marriage From The Perspective Of Islamic Family Law (Federal Territories) Act 1984(CLJ Legal Network Sdn Bhd, 2020) ;Haliza A. Shukor ;Intan Nadia Ghulam Khan ;Hasnizam HashimNabilah YusofIslamic jurisprudence has clearly set forth the laws in regulating matters pertaining to Muslim family institutions. Among the issues related to family institutions is syndicate marriage. According to a report in 2019, 70% of syndicate marriages are regarded as invalid due to its failure to fulfill the pillars of nikah. As such, it attracts various penalties under the Islamic Law Acts/Enactments. By referring to the Islamic Family Law (Federal Territories) Act 1984 (IFLA 1984), there are provisions which can be used to penalise parties who conduct or enter into a syndicate marriage. Therefore, this article will identify the relevant provisions in IFLA 1984 which considers syndicate marriage as shariah criminal offences. Shukor ;Nabilah YusofHasnizam HashimSustainable solid waste management contributes to three important aspects of sustainable development, namely, the environment, and economics, and social well-being. Electronic waste (also known as e-waste) is a type of household hazardous waste that will contribute to environmental pollution if it is managed unsustainably, as its disposal in landfills will contribute toxic substances to the landfill leachate, which subsequently could adversely affect the environment. Therefore, the purpose of this paper is to analyse the sustainable household e-waste management in Malaysia from a legal perspective by employing library research methodology. The lack of a legislation in respect of household e-waste management is identified as one of the challenges, which has caused difficulty in managing household e-waste. Hence, there is a need to improve the existing legal framework to enhance the sustainable management of household e-waste in Malaysia.
