The Islamic judicial system is theoretically and practically being considered distinguished from conventional judicial system on the basis of principle difference of ultimate sovereignty. The sovereignty of Allah Almighty is considered the ultimate sovereignty in an Islamic judicial system and therefore, the laws for individual and society is made under the divine guidance, while in conventional states the sovereignty lies in the hands of human beings. Publication Coroner’s Preventive Role In Occupational And Industrial Calamities: A Fundamental Legal Review(Faculty of Syariah and Law, Universiti Sains Islam Malaysia, 2020-10-27)Noorfajri IsmailThis paper focuses on the coroner’s investigative role that relates to occupational death cases. Any death caused by industrial calamities occurred in the course of employment needs to be investigated thoroughly. The methodology used in this study is qualitative approach, which involves analysing data gathered through legislation, cases-law and official statistics; and comparative analysis with other jurisdictions. This research finds that the Malaysian occupational death investigation system needs to be reformed as the coronial institution is able to serve as an effective death investigator especially in giving recommendations for the prevention of future similar deaths. - Some of the metrics are blocked by yourconsent settings

The Supreme Court has used digital transformation in court administration by developing an electronic court system or e-Court since 2018. However, procedural law has no legal basis related to electronic trials. The development of online dispute resolution is very fast, while procedural principles regarding due process and neutrality must remain the court's main task. In addition, establishing Internet courts involves three fundamental legal ethical principles: restoring the ceremonial aspects of litigation and creating risk management mechanisms between the legal and technological systems. This study aims to analyze the court's efforts to create an effective and efficient trial in Indonesia. A normative legal method was employed, incorporating various approaches such as the statute, conceptual, and comparative approaches. The research results show that the digital transformation policy was incorporated into the 2010-2035 blueprint of the Supreme Court of the Republic of Indonesia, which has brought about the need to accelerate digital transformation in the justice system. Settlement of civil disputes is carried out using an electronic court (e-court) application with an electronic litigation (e-litigation) mechanism. Meanwhile, the criminal trial was conducted through teleconference media. Still, they have encountered obstacles: limited facilities and infrastructure in conducting the trial, such as internet stability in various regions and limited courtrooms with electronic trial equipment. Publication Investigation procedures in syariah criminal cases Challenges faced by Malaysian syariah enforcement officers in exercise of their arrest power(Mediterranean Center of Social and Educational Research, 2014)Noorfajri IsmailEvery society yearns for justice and fundamental liberties. Nevertheless, the present global demand for unqualified freedom and liberties has turned the task of conducting an arrest into a daunting one. First and foremost, an arrest must be carried out in accordance with law. Secondly, an arrest must also conform to principles on human rights and liberties, which is the matter of striking a balance between individual rights and the rights of the society. In this matter, individual rights to move freely without being subjected to unlawful arrest must be balanced up with the rights of the society to be protected from crimes. Such challenges are also faced by the syariah enforcement officers when conducting arrest on suspects in Malaysian syariah criminal cases. Hence, this research analyses the issue of arrest in Malaysian syariah criminal cases by looking at syariah principles and relevant legal provisions. It then identifies problems pertaining to the issue of arrest and suggests some relevant and practical solutions to them. It is also important to note that most of the syariah criminal cases referred to in this research are cases which are still under investigation. Publication Managing Coroner’s Court In Malaysia: Recent Development Of Inquest Proceedings(USIM Tijarah Publishing Sdn. Bhd., 2022)Noorfajri IsmailThis article analyzing the related procedure and management of sudden death investigation by the coroner in Malaysia. The main purpose of inquest should be to identify the actual cause of death behind the death as to balance the interest between the rights and the interest of the deceased’s family member. However, the current legal framework is complex, hence defeat the actual purpose and objective of such investigation by the coroner. It is also submitted that the current procedure has created nonuniformity in practice by the coroners. This article employs method of legal case analysis and found several decisions made by the coroners was reviewed by the higher court on the application of the deceased’s family member. Such cases reviewed created a few questions on the effectiveness of the current management of coroner’s court. Ia akan sentiasa ada selagi mana wujud krisis dan konflik di sebuah negara tertentu. Orang pelarian adalah dilindungi di bawah prinsip non-refoulement dalam undang-undang adat antarabangsa. Di bawah undang-undang ini setiap negara mempunyai tanggungjawab untuk tidak memaksa pulang orang pelarian ke situasi di mana nyawa atau kebebasannya terancam tanpa mengira sama ada negara itu adalah pihak kepada Konvensyen 1951 Berkaitan Orang Pelarian atau tidak. Dalam agama Islam, prinsip ini telah digariskan sejak lebih 14 abad yang lalu menerusi ajaran agama yang termaktub dalam Quran dan Sunnah serta diamalkan oleh Nabi SAW dan para sahabatnya. Artikel ini akan mengkaji perbandingan di antara Undang-Undang Adat Antarabangsa dan Islam dalam memperlakukan orang pelarian dan statusnya. Berdasarkan kaedah kajian analisa dan perbandingan menggunakan data dan kajian kepustakaan, isu status orang pelarian dan hak mendapatkan perlindungan dihuraikan dan dikaji mengikut peruntukan undang-undang adat antarabangsa serta amalan agama Islam. Diantara hasil kajian adalah bahawa Islam melihat perlindungan kepada manusia adalah satu hak asasi yang tidak boleh dinafikan. Perlindungan kepada orang pelarian atas pelbagai sebab, khasnya yang melibatkan ancaman keselamatan diri dan nyawa sangat diperhatikan. BI merupakan sebuah pendekatan induktif dalam pembuatan sesuatu dasar yang menggabungkan elemen psikologi, sains kognitif dan sains sosial dengan hasil yang diuji secara empirikal untuk mengetahui tingkah laku manusia sebenarnya dalam membuat pilihan. Kaedah BI merupakan usaha penggubalan dasar awam untuk memahami tingkah laku manusia dalam merangka intervensi dasar. Langkah mengintegrasi BI dalam proses pembuatan dasar dilihat sebagai sesuatu yang perlu diterapkan dalam pelaksanaan polisi kerajaan bagi membolehkan pembuat dasar dan pengawal selia menjangkakan impak tingkah laku polisi lantas mewujudkan peraturan dan undang-undang yang lebih berkesan serta berkualiti. Pihak Berkuasa Tempatan khususnya Majlis Perbandaran Sungai Petani, Kedah (MPSP) berdepan cabaran dalam menguatkuasakan pembayaran kompaun di dalam kawasan pentadbirannya. Namun demikian, kewujudan urusniaga ini di dalam pasaran harta tanah telah mengundang pelbagai reaksi negatif terutamanya di kalangan pembeli harta tanah kerana mereka mendakwa urusniaga hanya memberi keuntungan kepada pemilik tanah dan pemaju harta tanah, dan mengabaikan kepentingan pembeli harta tanah. Justeru, kajian ini mempunyai dua objektif. Pertama, ia bagi menjelaskan kedudukan pemegang pajakan di dalam skim pajakan persendirian strata berdasarkan peruntukan undang-undang sedia ada yang berkaitan di Malaysia. Keduanya, bagi mengenal pasti tahap pengetahuan dan pandangan pemegang pajakan harta tanah di skim pajakan persendirian strata dan juga ejen pengurusan harta tanah yang berkaitan, terhadap isu-isu pengurusan skim pajakan persendirian strata ini. Kajian dijalankan menggunakan pendekatan kualitatif dengan menemubual pembeli dan pengurus harta tanah yang dilantik di skim pajakan persendirian strata yang terdapat di Medini, Johor. Hasil kajian mendapati bahawa tiada peruntukan undang-undang yang khas tentang kedudukan pemegang pajakan di dalam perbadanan pengurusan skim strata sebegini, justeru mengundang kebimbangan di kalangan pembeli yang pada masa yang sama kurang memahami tentang konsep skim pajakan persendirian strata ini di bawah peruntukan undang-undang sedia ada di Malaysia. Pengurus harta tanah yang dilantik juga tidak jelas tentang proses pengurusan yang sebenar selain menghadapi pelbagai masalah dalam menguruskan skim strata terbabit khususnya berhubung kutipan caj penyelenggaraan. Publication Pertikaian Polisi dan Perundangan Tanah dalam Cadangan Pembangunan Tanah(USIM Press, 2023) ;Ahmad Hamidi Mohamed ;Noorfajri IsmailKamilah Wati MohdThe processes involved in development are strongly tied to the land development policy and regulation. The Town and Country Planning Act 1976 [Act 172] and the National Land Code [Act 828] are among the laws regulating these processes. Cases such as SubangJaya Municipal Council v. Visamaya Sdn. Bhd & Anor is one of the cases on the conflict of land conditions in the National Land Code (now revised in 2020 with the number [Act 828]) ("KTN") with the land use zone contained in the Local Plan issued by the Local Authority (PBT). Its decision offers a valuable lesson in legal matters and land planning. This study intends to take a firm stance on the interaction between land-related legislation, such as TCPA [Act 172] and KTN. Studies are carried out using the most recent court rulings and legislative modifications, using a doctrinal approach as the primary methodology. The Town and Country Planning Act of 1976 [Act 172] (often known as "Act 172") is the primary statute cited in project planning for development, according to the study. On the other hand, KTN, which went into effect on January 1, 1966, is the most significant land law in Peninsular Malaysia. The alleged legal inconsistencies must be clarified and justified, and this requires a thorough comprehension of the development of the relevant legislation's original process and original intent. However, its emergence is not without issue as it was claimed to bring more benefits to the land owners than to the buyers who became the properties’ lessees. Therefore, the aim of this paper is twofold: to examine the disadvantages of buying an apartment through private lease, and to study the potential of the build-then-sell approach as possible solution to secure buyer’s interest. Publication Qarinah: Admissibility of Circumstantial Evidence in Hudud and Qisas Cases(Mediterranean Center of Social and Educational Research, 2015)Noorfajri IsmailTwo recent developments in Brunei and Malaysia on hudud and qisas implementation have revived the keen discussion and debate on admissibility of qarinah. The Brunei monarch has already approved the hudud, qisas and ta’zir implementation and a special committee has already been set up to look into several substantive, procedural and administrative matters. In Malaysia, the Kelantan government is currently looking into some preliminary matters regarding hudud, qisas and ta’zir application in view of the recent Federal Government’s green light on the said syariah criminal law application. The said state government is already in the midst of engaging itself into important discussions with other relevant authorities on the said matter. In view of these two recent developments, this paper strives at analyzing the issue of qarinah admissibility in hudud and qisas cases. Attempt is also made in identifying some misconceptions on the said issue while coming up with some analytical response on dispelling the misconceptions. © 2015, Mediterranean Center of Social and Educational Research. Publication A Qualitative Study on the Doctrine of Privity to Circumvent its Effect on Subcontractor’s Payment Claim(Malaysian Institute of Planners, 2023) ;See Zhi Yan ;Mohd Suhaimi Mohd-Danuri ;Noorfajri Ismail ;Othman MohamedFadzida IsmailIn common law jurisdictions, the doctrine of privity has been criticised by the judiciary and academic commentators, particularly the second rule of doctrine, which states that a person who is not a party to the contract cannot sue on it to obtain promised performance, although the contract has been formed with the intention to benefit him. In certain circumstances, this rule may produce unfair and injustice result to the third party of a contract, as it prohibits the third party from enforcing the right to get benefits conferred on them. The doctrine of privity becomes relevant in the context of tendering procedures when subcontractors, who are not direct parties to the main construction contract, are involved. Hence, the aim of this paper is two-fold: to highlight the difficulties of the existing legal mechanism associated with privity rule and to suggest possible ways to circumvent the effect of the doctrine of privity on subcontractors’ payment claims in the Malaysian construction industry. By adopting the socio legal research approach, the impact of the doctrine of privity, the difficulties of the existing legal mechanisms, and the need for a possible law reform were examined. The findings were also validated by conducting semi-structured interviews with five construction law experts. Among others, the findings showed that enhancement to the existing legal mechanisms and statutory intervention can effectively circumvent the privity rule and protect the subcontractor’s right for the payment claim. - Some of the metrics are blocked by yourconsent settings
