Landowners might be wondering why land fraud cases keep cropping up notwithstanding efforts and measures towards its prevention has been continuously implemented and monitored. Transition from paper-based to computerised land administration system with the implementation of the Computerised Land Registration System and e-tanah pave opportunities for new form of land fraud. The unpleasant truth is the more sophisticated the system, the more inventive the fraudsters can be. This paper seeks to analyse the challenges of fraud in land administration system by examining modus operandi in land fraud through selected decided cases. The research employs a doctrinal legal approach by examining authoritative legal texts and decided cases to analyse the issue. The findings from the analysis recognise that systematic fraud preventive actions are necessary in combating land fraud, and this include risk mitigating instruments in the form of land title assurance fund. Maqasid Syariah in its approach also emphasises preservation of integral pillars to redress the challenges of fraud in Malaysia.

Masalah homoseksual di seluruh dunia kian membimbangkan dan Malaysia turut tidak terlepas dari terkena tempias amalan songsang ini. Tambah merunsingkan adalah apabila perangkaan statistik menunjukkan peningkatan trend individu yang mengamalkan homoseksual (gay) ini. Sesungguhnya orientasi seksual terhadap sesamajenis ini mempunyai pelbagai implikasi negatif kepada pengamalnya dan individu di sekeliling mereka seperti ibu bapa dan rakan sebaya. Justeru, kajian ini dijalankan adalah untuk mengenal pastifaktor pengukuhan orientasi seksual terhadap sesama jenis (gay) dalam kalangan remaja lelaki serta implikasinya terhadap keluarga dan rakan sebaya. Maklumat yang diketengahkan adalah berdasarkan kajian kualitatif melalui reka bentukkajian skop. Sebanyak 36 artikel telah dijumpai dan dipilih dari EBSCO-Host, pangkalan data universiti bermula dari tahun 2015 hingga Januari 2021. Melalui teori pengukuhan atau pembentukan identiti gay yang dikemukakan oleh Cass (1996), pemahaman terhadap pengukuhan orientasi seksual terhadap sesama jenis dalam kalangan remaja dapat dihuraikansecara terperinci. Kajian mendapati bahawa terdapat pelbagai faktor yang membawa kepada pengukuhan orientasi seksual terhadap gay termasuklah faktor genetik, gaya asuhan ibu bapa, naluri dan faktor persekitaran. Orientasi seksual terhadap sesamajenis inijuga telah memberikan pelbagai implikasi negatif kepada perhubungan antara ibu bapa dan rakan sebaya. Konklusinya, kajian ini amatlah relevandan signifikan dalam membincangkan isu homoseksual kerana ia dapat membantu badan-badan terlibat termasuklah keluarga dan rakan sebaya dalam mengatur strategi-strategi terpilih bagi berhadapan dengan implikasi buruk dari amalan homoseksual ini

Despite the government various preventive measures, fraud and forgery incidents in land transactions have continue to emerge throughout the years. As for court, the main challenge in deciding the competing interest between the original owner and bona fide purchaser in fraud cases is whose interests should prevail. Under the concept of indefeasibility of title, one party will suffer loss over another at the end of the trial. To mitigate this issue, court has made several observations on the necessity to establish an assurance fund to compensate innocent parties who are deprived of their title or interest through no fault of their own. This study will investigate the role of the assurance fund in the land registration system using doctrinal legal research approach. Findings from the analysis will be able to identify several weaknesses in the system and generate recommendations to strengthen the land registration system in Malaysia.

Various research has given valuable insights into the positive role of Clinical Legal Education (CLE). However, there is a dearth of empirical data reviewing the set-up of CLE in public law schools in Malaysia and assessing its role as a teaching and learning strategy in legal education. This paper summarises the development and structure of the Faculty of Syariah and Law's Legal Clinic pilot initiative at the Universiti Sains Islam Malaysia (USIM). It assesses the impacts of the initiative on students' learning experience. The assessment involved a content analysis of written feedback given by a batch of pioneer students selected to join the FSU Legal Clinics pilot project in 2019. The findings indicated that the students believe exposure to the legal clinic increases their comprehension of the law's application and provides awareness of the professional skills and values involved in the legal profession. The sample is small, and the findings are preliminary. However, it is hoped that the results will inform legal curriculum developers of the benefits that law students derived from their clinical experience and provide a basis for further research into formally including clinical legal education in the FSU legal curriculum. This paper also advocates that although setting up, planning and organising activities for a successful legal clinic involved a great deal of preparation, it would benefit students and be integral to teaching and learning strategy in legal education in FSU USIM.

Sulh dan mediasi merupakan kaedah penyelesaian pertikaian yang digunakan di Mahkamah Syariah sebagai jalan keluar untuk menyelesaikan persengketaan secara perdamaian. Perintah Kawalan Pergerakan (PKP) semasa krisis pandemik Covid-19 telah menyebabkan peningkatan konflik keluarga dan kes perceraian yang tinggi dalam kalangan masyarakat Malaysia. Artikel ini bertujuan mengkaji prospek dan cabaran dalam pelaksanaan proses mediasi dalam Majlis Sulh (sulh-mediasi) secara dalam talian di mahkamah Syariah sebagai satu norma baharu. Kajian menumpukan kepada aspek perundangan dan amalan di Mahkamah Syariah. Kaedah penyelidikan yang digunakan adalah kajian kualitatif dengan pendekatan kajian kepustakaan, tinjauan literatur dan analisis kandungan. Dapatan kajian menunjukkan bahawa walaupun sesi sulh-mediasi secara dalam talian mempunyai cabaran dari segi penggunaan teknologi, sosial dan perundangan namun ia mempunyai prospek yang besar bagi penyelesaian pertikaian secara perdamaian. Sebagai penutup kaedah sulh-mediasi dalam talian ini boleh dimanfaatkan sebagai satu persediaan menghadapi kaedah penyelesaian konflik masa hadapan yang lebih fleksibel, murah, cepat dan berkesan.

A road traffic accident is an unwanted incident that involved a motor-propelled vehicle that occurs on any publicly accessible road. Malaysia as one of the middle and low-income countries that represent 60% of vehicles and 85% of the total population around the world, accounted for more than 90% of all deaths caused by road traffic accidents. The objective of this article is to understand the reason that despite the government having enacted legislation and implemented enforcement policies, the accident rate in Malaysia continues to increase. The methodology of this article focused on literatures extracted from online sources namely SCOPUS, Google Scholar, and MyJurnal. The literatures extracted from the online sources were analyze with adherence to the PRISMA steps. As result, this article analyse the effectiveness of the government legislation and enforcement policies, highlight the gaps that exists that hamper its effectiveness curb road traffic accident and propose justifiable recommendations in terms of improving the legislation and enforcement policies in Malaysia.
