Problematika Kontekstualisasi Fiqh di Indonesia

Fiqh, which is a product of medieval science within the boundaries of schools of thought, finds problems in its contextualization. In general, there are two groups of mainstream opinions on the contextualization of fiqh, namely, groups that use a formal-textual approach and groups that emphasize a cultural-substantial approach. In the midst of these mainstream opinions, a moderate offer emerges in the form of Indonesian fiqh, namely, the concept of fiqh thinking which is to be formulated in accordance with the Indonesian context, or at least fiqh which can respond to the legal needs of the Indonesian people.
