Abstract

Autism Spectrum Disorder (ASD) or widely known as autism means taking oneself away from reality. Autism is categorised under a group of Person with Disabilities (PWD) under the learning disabilities type, based on the criteria set out in the PWD Act 2008. Through inductive and deductive analysis methods, this article aims to analyse the documentation of data in various published or unrelated literature with legal perspectives and Islamic law in discussing autism. This matter is closely related to the issue wherein under Islamic law and jurisprudence, there are still problems that need to be discussed and further elaborated in relation to autism. The results of the study found that there had not been sufficient discussions on autism from legal perspectives. Currently, discussions in the legal aspect are mostly in relation to PWD in general and are not referring specifically to the autistic group who have different attitudes and actions. Meanwhile, from the perspective of Islamic law, autism is categorised as mental illness due to the low level of maturity and involved children who does not reach the level of mumayyiz. Hence, this perspective will definitely affect the carrying out of religious activities as well as their responsibilities towards the same. Therefore, it is hoped that this discussion can open up further views and understanding from Islamic law perspectives, that specific law involving autism should be given higher attention in addressing various issues related to the same.
