As for court, the main challenge in deciding the competing interest between the original owner and bona fide purchaser in fraud cases is whose interests should prevail. Under the concept of indefeasibility of title, one party will suffer loss over another at the end of the trial. To mitigate this issue, court has made several observations on the necessity to establish an assurance fund to compensate innocent parties who are deprived of their title or interest through no fault of their own. This study will investigate the role of the assurance fund in the land registration system using doctrinal legal research approach.
