The importance of this study is evident by the difference of opinion among scholars, every now and then, in their discourse of this issue comprehensive with multiple evidence from every aspect. The study is started by outlining the fundamental points of the divine revelation (al-waḥyu) and juristic reasoning (al-‘ijtihād) in order to define them accordingly. The researcher then analyses views of scholars in this case together with the evidence put forward by them before clarifying the implications of choosing each of the aforementioned view. Finally, the researcher determining the al-ra’yu al-rājiḥ (preponderant opinion) among them together with the reasons for the al-tarjīḥ.
