Publication Document Falsification/Forgery from the View of Islamic Jurisprudence and Malaysian Law(Al-Jamiah Research Centre of Sunan Kalijaga State, 2020) ;Wan Abdul Fattah Wan Ismail, ;Ahmad Syukran Baharuddin, ;Lukman Abdul Mutalib,Although the scholars of Islamic jurisprudence discussed the importance of document and its strength as a mean of proof, they did not discuss the issue of forgery unless slightly compared with the scholars of law. This is due to its limited extension and uses in the period of times. And with the frequent use of them in our time, the debates have extended towards several circumstances either to attempt for or to deny a forgery. Therefore, this research is conducted to study the document falsification from the perspectives of Islamic Jurisprudence and Malaysian Law. It is also to explain the definition, procedure and methods to identify the crime and its punishment. The study used inductive and content analysis methods on previous scholars’ opinions, discussions and explanation from two different legal institutions. This study found the following important results: The are many forms of forgery occur in this era and can be classified either as material or incorporeal fraud. Several implications have been issued against the forgery crime in the Malaysian Penal Code, such as imprisonment, lashes and fines. The Islamic jurisprudence and the Malaysian Evidence Act 1950 has established several methods to verify the validity of documents such as confession, testimony, expert opinion, and oath, but the opinion of the expert is the most important means in verifying the authenticity and originality of documents. This study also found that the Malaysian Evidence Law did not discuss the oath as a mean to verify documents. As analysed, the method to verify documents discussed in the books of jurisprudence is very different from that of the Malaysian Evidence Act 1950, which specifies the conditions of documents and the number of witnesses, but the law does not specify the number of witnesses and impose conditions only. [Meskipun para ahli tata hukum Islam membahas pentingnya sebuah dokumen sebagai alat bukti, namun mereka kurang membahas persoalan pemalsuan dokumen sedalam para ahli hukum konvensional. Hal ini terkait dengan terbatasnya waktu dan kuantitas penggunaan, sehingga frekuensi penggunaannya memunculkan debat yang panjang, baik yang menerima atau yang menolak soal pemalsuan. Oleh karena itu, artikel ini membahas pemalsuan dokumen dari perspektif tata hukum Islam dan hukum nasional di Malaysia. Artikel ini juga menjelaskan definisi, prosedur, dan metode identifikasi kejahatan ini serta hukumannya. Penulis menggunakan metode induktif dan analisis isi pada opini, perdebatan, dan penjelasan dari dua institusi hukum yang berbeda. Kajian ini menyimpulkan adanya beragam bentuk pemalsuan dewasa ini, baik material atau non material. Beberapa aturan hukum telah dikeluarkan di Malaysia dan sangsi nya seperti penjara, cambuk dan denda. Peradilan Islam dan Undang Undang Saksi Tahun 1950 telah menetapkan beberapa metode untuk validasi dokumen seperti: pengakuan, testimoni, pendapat ahli, dan sumpah, namun pendapat dari ahli masih merupakan cara utama untuk verifikasi keautentikan dan keaslian dokumen. Artikel ini juga menemukan bahwa peraturan hukum di Malaysia belum membahas sumpah sebagai alat verifikasi dokumen. Publication Forensic Science Application towards Rahmatan Lil Alamin: An Appraisal within the Context of Justice(USIM Press, 2019) ;Ahmad Syukran Baharuddin,Muhammad Hazim Ahmad,The idea of Rahmatan Lil ‘Alamin is predominantly derived from Surah al-Anbiya, verse 107. The lexicon “rahmat” connotes various interpretations that include Islam and al-Qur’an. Meanwhile, al- Qur’an was revealed to Prophet Muhammad (p.b.u.h.) which contains principles and injunctions as a proclamation and guideline to mankind. This revelation intends to preserve the public interests while preventing from harm. The objective of this study is to analyse the appraisal of forensic science application within the context of justice. This study aims to appraise the nexus between concept Rahmatan Lil ‘Alamin and al-Maqāṣid al-Sharīʿah. This qualitative study used documentary research method in collecting primary and secondary data. The data have been analysed using content analysis method by adapting inductive reasoning. The appraisal of forensic science application within the context of justice indicates numbers of findings; the forensic science application is permissible in Islam. It also denotes forensic science have been long practiced since the prophet era, where numbers of forensic methods have been applied to uphold the justice at that time. Apart from that, there was also a nexus between the concept of Rahmatan Lil ‘Alamin and al-Maqāṣid al-Sharīʿah. The relation can be seen from the common purpose of both concepts which are preserving the public interest and preventing harm. Therefore, the application of forensic science shall be the meeting point between forensic science application, concept Rahmatan Lil ‘Alamin and al-Maqāṣid al-Sharīʿah. It bridges the gap between science and shariah. This study contributes in building the integration between science and shariah elements through application of forensic science and the concept of Rahmatan Lil ‘Alamin. This study has also indirectly proved the concept of al-shumūl, al-thabāt, and al-murūnah in Islamic teachings that encompassed various fields of knowledge. Wabak ini pada mulanya dikesan di pertengahan Disember 2019 di Bandaraya Wuhan, Hubei China dan telah diiktiraf sebagai pandemik oleh Pertubuhan Kesihatan Sedunia (WHO) pada 11 Mac 2020. Pandemik COVID-19 boleh membawa maut kepada penghidapnya dan hingga ke saat belum pakat perubatan belum menemui ubat atau rawatan secara spesifik kepada Pandemik COVID-19. Namun setakat in belum terdapat kajian secara spesifik mengenai kesan hibah yang dibuat bagi penghidap COVID-19. Kertas kerja ini akan membincang mengenai konsep marad al-mawt menurut fiqh dan perubatan. Penjelasan turut dibuat mengenai status penghidap COVID-19 kategori penyakit terminal atau marad al-mawt menurut fiqh diikuti beberapa kes yang pernah dilaporkan berkenaan marad al-mawt. Publication Program Pemulihan Luar Penjara bagi Pesalah Jenayah Syariah: Kajian di Jabatan Penjara Malaysia(Universiti Kebangsaan Malaysia, 2021) ;Hasnizam Hashim, ;Hendun Abd. Rahman Shah, ;Ahmad Syukran Baharuddin, ;Mualimin Mochammad Sahid,Syaryanti HussinPenjara pada masa kini sebenarnya bukan sahaja menjadi tempat untuk menghukum mereka yang melakukan kesalahan, namun lebih menjurus sebagai institusi yang bertanggungjawab untuk memulih, memimpin dan mendidik pesalah agar menjadi individu yang berdisiplin dan bertanggungjawab setelah mereka kembali ke pangkuan masyarakat. Dalam konteks Malaysia, agenda pemulihan pesalah jenayah termasuk pesalah jenayah syariah adalah merupakan agenda utama kerajaan dalam usaha mengurangkan kadar jenayah. Menyedari hakikat ini, Kerajaan Malaysia melalui Pelan Hala Tuju Transformasi telah memberi penekanan terhadap kepentingan memperbaiki program pemulihan tidak hanya di dalam penjara bahkan turut melaksanakan pelbagai program pemulihan di luar penjara dalam usaha mempersiapkan pesalah jenayah agar dapat kembali semula ke pangkuan masyarakat apabila mereka dibebaskan sepenuhnya. Penulisan yang menggunakan pendekatan kualitatif ini akan menjelaskan mengenai program pemulihan di luar penjara yang dilaksanakan oleh Jabatan Penjara Malaysia ke atas pesalah jenayah syariah yang menjalani hukuman penjara. Penulisan dibuat dengan merujuk kepada dokumen berkaitan modul pemulihan serta temu bual pakar. Penulisan ini penting bagi mengetengahkan pengalaman Jabatan Penjara Malaysia dalam membangun dan melaksanakan modul pemulihan bagi pesalah jenayah di luar penjara. Kajian mendapati bahawa pembangunan modul pemulihan bagi pesalah jenayah syariah yang menjalani program pemulihan di luar penjara adalah seimbang dengan mengambil kira aspek pemulihan fizikal, mental, sikap, akhlak dan rohani. Walau bagaimanapun, pelaksanaan program pemulihan di luar penjara bagi pesalah Syariah ini sebenarnya perlu dilihat dan dikaji semula dari segi kerelevanannya. - Some of the metrics are blocked by yourconsent settings
Publication Three-Dimensional (3D) Printed Food Products From Halal Forensic Perspective: A Prelimenary Review(USIM Press, 2022) ;Ummu Hani Roslin ;Mohd Ifwat Mohd Ghazali ;Mohamed Faiz Asyraf RazaliAhmad Syukran Baharuddin,The emergence of three-dimensional printed (3DP) technology in the food industry is one of the possibilities for a source of global halal food supply in the future. Producing individualized nutritional meals, food sustainability, and developing new solutions worldwide are just a few of the benefits of using 3DP. However, there are still issues with 3DP, especially regarding safety issues and all the risks to the consumer that needs to be overcome. Besides, it will safeguard each essential component of food production for commercial purposes and acceptance by the public. The objective of this study is to gather information regarding the potential of 3DP as well as its availability in the halal market. This study revolves around the five main pillars of halal forensics for halal-based products. This qualitative study employs library research as the data collection method. Data were analysed using content analysis method. Based on this study, a new regulatory framework for halal 3DP food products can be suggested through the halal forensics concept. This allows the authenticity of halal 3DP food products to be certified to safeguard consumers when consuming especially the Muslim community.
