Publication The Challenges of Fraud to Land Administration System in Malaysia(Penerbit USIM, 2022) ;Kamilah Wati Mohd ;Adzidah YaakobNorsuhaida Che MusaLandowners might be wondering why land fraud cases keep cropping up notwithstanding efforts and measures towards its prevention has been continuously implemented and monitored. Transition from paper-based to computerised land administration system with the implementation of the Computerised Land Registration System and e-tanah pave opportunities for new form of land fraud. The unpleasant truth is the more sophisticated the system, the more inventive the fraudsters can be. This paper seeks to analyse the challenges of fraud in land administration system by examining modus operandi in land fraud through selected decided cases. The research employs a doctrinal legal approach by examining authoritative legal texts and decided cases to analyse the issue. The findings from the analysis recognise that systematic fraud preventive actions are necessary in combating land fraud, and this include risk mitigating instruments in the form of land title assurance fund. Maqasid Syariah in its approach also emphasises preservation of integral pillars to redress the challenges of fraud in Malaysia. - Some of the metrics are blocked by yourconsent settings
Publication Customary Land Rights Of Orang Asli: A Case Study In Kampung Parit Gong, Negeri Sembilan, Malaysia(Universiti Sains Islam Malaysia, 2021-01) ;Kamilah Wati Mohd ;Fareed Mohd Hassan ;Intan Nadia Ghulam KhanIzawati WookThe Orang Asli group forms a minority community in Peninsular Malaysia, whose livelihood mostly depends on their land and the surrounding area. Dispute over customary land rights of Orang Asli has been continual in Malaysia although Malaysian Courts, in several cases, have upheld the Common Law rights of Orang Asli to their customary lands. This poses a challenge to some Orang Asli communities and State Governments. Based on focus group discussion, profiling survey, and library research methods, this paper analyses the land rights of Orang Asli in Peninsular Malaysia, by placing focus on Orang Asli in Kampung Parit Gong, Jelebu, Negeri Sembilan. The findings indicate that the Kampung Parit Gong Orang Asli community has been strictly adhering to the customs of ‘Adat Perpatih’ since yesteryears, and that they highly value the land, both through usage of land and by inheritance. Several important concerns were raised by the Orang Asli in Kampung Parit Gong, particularly on the security over their rights on the said customary land and the guarantee of their future generations’ socio-economic well-being. Having said that, this paper proposes several legal and administrative measures to not only address the uprising issues, but also to ascertain that the rights of Orang Asli residing in Peninsular Malaysia are safeguarded. - Some of the metrics are blocked by yourconsent settings

Fakta menunjukkan bahawa terdapat sejumlah harta peninggalan si mati yang bernilai jutaan ringgit terabai dan tidak diuruskan secara baik. Hal ini turut menyumbang kepada lambakan harta pusaka yang tidak bernilai dan bermanfaat kepada ahli keluarga atau waris. Harta pusaka yang tidak diuruskan secara baik ini turut dilihat sebagai tidak mampu menyumbang kepada pembangunan ekonomi negara. Di samping itu, terdapat isu-isu penipuan harta pusaka yang sering dibangkitkan di media massa yang merupakan indikasi tahap kesedaran yang rendah dalam memahami akan kepentingan pengurusan harta termasuk harta pusaka. Publication Kepentingan Tadbir Urus Yang Baik Dalam Mendepani Isu Penipuan Tanah(Universiti Sains Islam Malaysia, 2021-09-09)Kamilah Wati MohdTadbir urus yang baik dalam pentabiran tanah merupakan salah satu aspek penting dalam memastikan Wawasan Kemakmuran Bersama 2030 dapat direalisasikan. Ini kerana tanah sebagai satu aset yang sangat bernilai terdedah kepada penyalahgunaan kuasa dan penipuan oleh pelbagai pihak. Kajian ini meneliti kelemahan yang terdapat dalam pentadbiran tanah yang membolehkan berlakunya penipuan dalam urusniaga tanah yang menyebabkan kerugian bernilai jutaan ringgit. Kaedah yang digunakan dalam kajian ini ialah kaedah kualitatif bersumberkan data primer dan sekunder seperti statut, laporan kerajaan, artikel jurnal kes mahkamah dan laporan akhbar. Dapatan kajian ini menunjukkan terdapat beberapa kelemahan dalam sistem pentadbiran tanah yang merangkumi aspek peruntukan undang-undang, prosidur dan modal insan yang perlu diperlu diberi perhatian segera bagi menangani isu penipuan dalam urusniaga tanah. Kajian ini mencadangkan supaya kerajaan menambahbaik tadbir urus pentadbiran tanah seperti mewujudkan dana pampasan, meningkatkan langkah-langkah keselamatan digital dan memperkasakan modal insan bagi memastikan pembangunan mampam dapat dilaksanakan dalam menjayakan Wawasan Kemakmuran Bersama. Hakim Bin Mohad @ Mohamad RamliNot much is written about custom and customary law of Orang Asli communities, particularly on land matters, which the ownership remains contentious. Land is an essential foundation for the vulnerable indigenous peoples to maintain their livelihoods and identities. By providing a case analysis on the custom, practice, use and traditions relating to land of the Orang Asli Temuan in Negeri Sembilan, drawn on the framework of common law jurisprudence on indigenous peoples’ customary land, this paper illustrates the significance of land and its security for the communities. In particular, it investigates the concept, meaning and perspectives of customary land among Orang Asli in selected villages, i.e. Langkap, Kuala Pilah; Parit Gong, Jelebu; and Bukit Kepong, Pasir Panjang. It takes a qualitative approach through interviews and focus group discussion with the headmen, other leaders of the communities, and relevant stakeholders, including an expert in the Adat Perpatih (customary laws) which are practiced by the Temuan Orang Asli. The research found that the Temuan regard the land in which they live as a territory belonging to the community in which the members have different types of rights. Within that territory, families have ownership right over certain areas meant for different uses including for settlement and economic activities with boundaries known to the community members. The ownership of these areas of land is passed to the next generation according to their customary rules. This also includes the land regarded as ancestral land passed from their ancestors. Beside this part of land, areas surrounding the settlement and agricultural areas within the territory are regarded as common access meant for foraging to find food or other resources to add to their source of income. These common areas serve as buffer zone to members who are in need. This topic is under-researched yet vital for policy makers, decision makers and the public in paving the way for greater protection of indigenous peoples’ lands. - Some of the metrics are blocked by yourconsent settings
Publication Pertikaian Polisi dan Perundangan Tanah dalam Cadangan Pembangunan Tanah(USIM Press, 2023) ;Ahmad Hamidi Mohamed ;Noorfajri IsmailKamilah Wati MohdThe processes involved in development are strongly tied to the land development policy and regulation. The Town and Country Planning Act 1976 [Act 172] and the National Land Code [Act 828] are among the laws regulating these processes. Cases such as SubangJaya Municipal Council v. Visamaya Sdn. Bhd & Anor is one of the cases on the conflict of land conditions in the National Land Code (now revised in 2020 with the number [Act 828]) ("KTN") with the land use zone contained in the Local Plan issued by the Local Authority (PBT). Its decision offers a valuable lesson in legal matters and land planning. This study intends to take a firm stance on the interaction between land-related legislation, such as TCPA [Act 172] and KTN. Studies are carried out using the most recent court rulings and legislative modifications, using a doctrinal approach as the primary methodology. The Town and Country Planning Act of 1976 [Act 172] (often known as "Act 172") is the primary statute cited in project planning for development, according to the study. On the other hand, KTN, which went into effect on January 1, 1966, is the most significant land law in Peninsular Malaysia. The alleged legal inconsistencies must be clarified and justified, and this requires a thorough comprehension of the development of the relevant legislation's original process and original intent. Publication Resolving Competing Claims Between Original Owner and Bona Fide Purchaser In Land Fraud Cases: Should an Assurance Fund Be the Alternative Solution?(Penerbit USIM, 2023) ;Kamilah Wati Mohd ;Adzidah YaakobNorsuhaida Che MusaDespite the government various preventive measures, fraud and forgery incidents in land transactions have continue to emerge throughout the years. As for court, the main challenge in deciding the competing interest between the original owner and bona fide purchaser in fraud cases is whose interests should prevail. Under the concept of indefeasibility of title, one party will suffer loss over another at the end of the trial. To mitigate this issue, court has made several observations on the necessity to establish an assurance fund to compensate innocent parties who are deprived of their title or interest through no fault of their own. This study will investigate the role of the assurance fund in the land registration system using doctrinal legal research approach. Sepertimana Hadis Rasulullah S.A. K "haji yang mabrur: tiada ganjaran baginya melainkan Syurga. Oleh sebab itu, seluruh umat Islam dimuka bumi Allah S. KT ini ingin melaksanakannya dengan harapan memperolehi haji mabrur. Namun persoalann~a, adakah semua Jemaah haji terutamanya dari Malaysia memperolehinya?. Kebanyahn jemaah haji yang melaksanakan rukun Islam yang kelima ini adalah dari golongan warga emas, ini adalah kerana kos serta perbelanjaannya yang tinggi dun ianya hanya dapat dihimpun apabila mencapai peringkat usia yang telah tua. Dan ketika melaksanakan ibadat haji dalam usia yang sudah uzur sudah pasti banyak dugaan yang ditempuhi ketika ingin memenuhi rukun dun wajib haji. Begitu juga bagigolongan muda ataupertengahan umur; keadaan cuaca, perbezaan mazhab, kurang pengalaman menyebabkan berlakrrnya perasaan was-wa didalam melaksanakan ibadat haji, sehingga merasakan ibadat haji yang dilaksanakan tidak sah atau kurang sempuma. Sebagai contoh dalam permasalah batal wudhuk dan sebagainya, mereka merasakan ibadat haji yang mereka lakukan di bawah kendalian Lembaga Tabung Haji Malaysia kurang sempurna dun tidak mengikut qaul mazhab Shajie yang muktamad. oleh sebab itu, mereka swing mempertikaikan Pihak Lembaga Tabung Hajj, dun kemudian mekdmkan ibadat tersebut berulang kali mengikut fahaman mereka sendiri. Inevitably, security of land tenure and dealings is vital in managing land resources as a trust from the Almighty to humankind. In view of this, Islam considers protection of property and wealth as one of the five fundamentals of shariah or the maqasid as-shariah. Similarly, the significance of secure land tenure for sustainable development has been acknowledged by the United Nations. This paper seeks to examine the advantages of safeguarding land tenure to the economic and social well-being as well as repercussions from failure to uphold the same particularly in facing the pandemic of covid-19. The research employs doctrinal approach. Bagi masyarakat minoriti orang asal khususnya, hak pegangan tanah yang selamat merupakan perkara asas bagi mengekalkan jati diri dan kehidupan mereka. Artikel ini menghuraikan hasil kajian kes tanah adat masyarakat orang asli di Negeri Sembilan, iaitu di Langkap, Kuala Pilah, Parit Gong di Jelebu dan Bukit Kepong di Port Dickson. Kajian ini berasaskan kerangka prinsip common law sebagai asas pengiktirafan tanah adat masyarakat asal di negara ini. Kajian kes menunjukkan bahawa masyarakat orang asli Temuan melihat tanah dan kawasan yang mereka tinggal, bertani dan sebagainya sebagai satu “kawasan” ataupun “wilayah” yang dimiliki oleh komuniti mereka yang dipelihara berasaskan adat perpatih bagi kesejahteraan komuniti pada masa ini serta generasi yang akan datang. Di dalam wilayah tersebut, terdapat kawasan di sekitar penempatan dan pertanian yang penting sebagai kawasan rayau yang berfungsi sebagai zon penyangga (buffer zone) kepada ahli yang memerlukan. Masyarakat orang asli mempunyai “sistem perundangan” mereka sendiri yang diatur oleh adat dan sistem komuniti yang tersusun dengan konsep wilayah tersendiri. Hasil kajian ini penting bagi memberikan pengetahuan dan kefahaman masyarakat di negara ini terhadap komuniti orang asli serta amalan mereka yang mungkin mampu membuka jalan ke arah perubahan dasar dan undang-undang yang memberikan perlindungan yang lebih baik kepada mereka selaras dengan matlamat pembangunan lestari.
