Publication Aplikasi Ijtihad Kolektif Dalam Fatwa Perubatan: Kajian Kes Terhadap Resolusi Akademi Fiqh Islam Antarabangsa (IIFA) Dari Tahun 1985 Hingga 1990(Universiti Sains Islam Malaysia, 2020-10-15) ;Mohammad Naqib bin Hamdan ;Mohd Anuar Ramli ;Hussein ‘Azeemi bin Abdullah Thaidi ;Nasrul Hisyam Nor Muhamad ;Ahmad Che Yaacub ;Aminuddin Ruskam ;Hussin SalamonSulaiman KadikonIjtihad kolektif merupakan suatu usaha bersepadu yang menggabungkan kepakaran pelbagai bidang dalam merungkai permasalah fiqh yang timbul. Antara permasalah fiqh yang memerlukan aplikasi ijtihad kolektif adalah isu perubatan kontemporari. Hal ini kerana, isu perubatan merupakan suatu isu kompleks yang memerlukan para sarjana hukum Islam memahami dahulu gambaran isu perubatan tersebut sebelum memutuskan sebarang hukum. Justeru, artikel ini akan membincangkan konsep ijtihad kolektif dan aplikasinya dalam isu perubatan kontemporari dengan menjadikan resolusi Akademi Fiqh Islam Antarabangsa (Internasional Islamic Fiqh Academy – IIFA) sebagai kajian kes. Kajian ini menggunakan metodologi kualititatif dengan menggabungkan analisis dokumen dan kajian kes. Hasil kajian menunjukkan IIFA telah memutuskan 29 resolusi perubatan daripada sejumlah 216 resolusi sepanjang 22 siri persidangan bermula tahun 1984 hingga 2015. Kajian kes ke atas 9 resolusi yang diputuskan pada tahun 1985 hingga 1990 menunjukkan semua resolusi diputuskan selepas melalui sesi perbincangan antara pakar rujuk hukum Islam dengan bantuan doktor pakar dalam bidang perubatan dan menepati konsep ijtihad kolektif. - Some of the metrics are blocked by yourconsent settings
Publication Congenital And Genetical Disorders’ (CGD) Association And Interaction With Covid-19 And Its Health Care Management Post Pandemic: A Maqasid-Based Approach(Penerbit USIM, 2022-12) ;Zizi Azlinda binti Mohd Yusof ;Nur Zaireena bt ZainalMohammad Naqib bin HamdanSince December 2019, Covid-19 infections have been threatening the balance of human lifetime in a number of areas, including the health care system, the economy, psychological characteristics, and the education gap. Millions of people, around the globe today, who survives from Covid-19 pandemic indeed struggling to live in a post-Covid complexities condition, particularly those who are having pre-existing comorbid conditions which include complicated congenital and genetic disorders (CGD). CGD event occurs out of chromosomal aberrations which may cause the congenital malformation and mental handicap since birth. Some studies show that some congenital and genetical disorders have great association with Covid-19 pandemic; although it may not have much significant physical effect, it is rather psychologically reflected and may pose a high-index of severity of Covid-19 complications and led to catastrophic event if not thread carefully. Some of these (CGD), are rare diseases which pose asymmetrical from different context toward the objective of preservation of live (hifz al-nafs), preservation of lineage (hifz al-nasl) and preservation of health (hifz al-sihhah). Covid-19 envisioned a difficult situation during and post COVID-19 pandemic, thus the bird’s -eye view through the maqasid syariah's is crucial. Herein, this qualitative methodology which using document review method will highlight a conceptual and practical gap within the health care management addressing some congenital and genetical disorders with Covid-19 pandemic, hoping that it will foster the higher objective of Islamic law from maqasid frameworks in a great deliberation in a way may create a model of handling congenital and genetical disorders’ (CGD) association and interaction with covid-19 and its health care management during pandemic.
