Publication Perdagangan Mata Wang Atas Talian (Online Forex Trading): Kewajaran Pengharamannya Dari Perspektif Syariah Dan Undang-Undang Malaysia(Universiti Sains Islam Malaysia, 2021-09-09) ;Nik Rahim Nik WajisNurliyana Shahira Binti BaharliPerdagangan mata wang atas talian (PMWAT) atau Online forex trading (OFT) adalah di antara jenis perdagangan yang semakin mendapat perhatian masyarakat pada masa kini. Pandemik COVID-19 dan Perintah Kawalan Pergerakan (PKP) menjadikan PMWAT ini semakin mendapat perhatian bagi dijadikan sumber pendapatan pantas bagi mengatasi masalah kewangan yang dihadapi. Satu fakta yang tidak dapat dinafikan PMWAT adalah di antara jenis perdagangan yang mempunyai tahap kecairan (liquidity) yang paling tinggi dalam pasaran kewangan dunia. Namun begitu, isu berkaitan pengharaman PMWAT masih menjadi perdebatan oleh pelbagai latar belakang masyarakat meskipun telah wujud fatwa yang mengharamkan urus niaga ini. Kajian ini menggunakan kaedah kualitatif dengan menganalisis kitab-kitab fiqh serta artikel dan jurnal bagi mengupas isu kedudukan PMWAT menurut perspektif Syariah serta undang-undang di Malaysia. Hasil kajian mendapati bahawa PMWAT adalah jenis perdagangan yang mempunyai rukun-rukun dan syarat-syarat khas kerana ianya termasuk dalam kategori Bai’ al-Sarf. Analisis kajian turut mendapati bahawa sistem PMWAT yang digunapakai pada masa kini adalah bertentangan dengan rukun dan syarat muamalat menurut syarak. Maka, hasil kajian berpandangan bahawa terdapat kewajaran dalam pengharaman PMWAT berdasarkan beberapa isu yang dibincangkan dalam artikel ini. Publication Perkahwinan Kanak-kanak Di Malaysia: Had Umur Minimum Dan Implikasinya(Universiti Sains Islam Malaysia, 2020-12) ;Nik Rahim Bin Nik Wajis, ;Mualimin Mochammad Sahid, ;Mohamad Ismail Bin Hj Mohamad Yunus,Nurliyana Shahira Binti BaharliDifferences of thought, understanding and interpretation of the law, and the effects of underage marriage lead to debate in society. Although there is a minimum age limit provided, but the law is seen as irrelevant to be applied nowadays because it is considered as a practice that can cause harm to children, family institutions and national development. Therefore, this article will discuss the position of child marriage according to Shariah and legal perspective. In addition, this article also discusses the position of child marriage under the Sustainable Development Goals (SDGs) as well as the implications of such marriages to children in terms of health and educational rights. This study uses a qualitative research methodology based on library research by analyzing primary and secondary documents such as the classical books (turath) and state enactments, as well as academic writings in the journals. The findings of the study indicate that there is a provision in the act and enactment of each state related to the child marriage. However, the details are not clear and specific about the reasons and factors that need to be taken into account in granting permission for child marriage. In addition, this article also found that there are negative implications on the health and educational rights of the children involved as a result of underage marriage. Therefore, this article suggested for improvement to the existing provisions in order to safeguard the welfare and rights of children.
