The criminal justice system faces the dilemma when children break the law, as children are considered as minors who are not legally responsible for their actions. In most cases, the society tend to focus on protecting children from neglect, abuse or harms but often overlooked of protecting children who are involved in harming or causing injury to other people or cause damage to property. It is equally important to address the growing concern on children‘s exposure to usage of the Internet. Thus, the question such as, can the child‘s wrongs on the Internet be considered as a de-linquent act, namely possible wrongful acts conducted by children that would otherwise be an offence if committed by an adult, is ex-plored. The legal status and minimum age of criminal responsibility in Malaysia are also examined. In addition, the Shariah views will be discussed briefly. Then, the paper explores the problems and challenges face by children in using social media websites. Finally, the paper suggests that the government and the community in particular parents and teachers have vital roles to play in ensuring that the poli-cies and rules provide mechanism not only to protect children but also to empower them as a citizen of the country. This may be done by advocating legal awareness and educating the children to be more responsible in their acts online and uphold respect in law, ethics and morality. - Some of the metrics are blocked by yourconsent settings
Publication Governing Teaching And Learning Syariah And Law During Covid-19: Some Reflections(Penerbit USIM, Universiti Sains Islam Malaysia, 2021-12-30) ;Syahirah Abdul Shukor ;Noor Dzuhaidah OsmanNurul Atira MusaThe unprecedented pandemic of Covid-19 not only effect the economic and administrative of the country, but it also has pushed to the closure of schools and universities. As a result, the emergence of e-learning or conducting classes via the teaching tools available online such as Microsoft team, google classroom, Zoom and Webex become so imminent to teachers and students. With pandemic of COVID-19, it seems global partnership is urgently needed with teaching and learning are done in a flexible manner by mean of distance learning using the teaching tools provided via the Internet. This article addresses the challenges faced by the university, particularly, in teaching and learning subjects of Syariah and law which need hand-on training and face-to-face lecturers and tutorials. This paper will examine the debates of protecting the public health in cases of COVID-19 as the world is still facing with the uncertainties brought by this dangerous virus. The new norms due to this pandemic introduced new practices such as no mass gathering which include no mass lecture or tutorials, social distancing and regular cleaning regime that are being addressed by the Ministry of Health to public. Hence, it begs to think how teaching and learning Syariah and Law can be materialized in this new norm? As a university which promotes integration of the concept of Naqli and Aqli Knowledge (iNAQ), a revisit to the current situation in facing COVID-19 is essential for the long-term planning of the higher education as well as short term approaches in dealing with its impact. The quality of the assessment made to the students by the lecturers are also crucial in addressing arising issues in teaching and learning during this pandemic. Publication Penyebaran Fahaman Bertentangan Akidah Islam Di Media Sosial Dari Perspektif Undang-undang Dan Syariah Di Malaysia(Universiti Sains Islam Malaysia, 2020-12) ;Nurul Atira MusaHendun Abd Rahman ShahNowadays, Muslims are often agitated by various issues involving the threats towards the Muslim faith and Islamic thought. The issue of apostasy, atheism, agnotisme, liberalism, and various ideologies which are against the true Islamic teaching have spread and threatened their beliefs and faith. Therefore, this article aims to reveal the reality of this threat among Muslims, particularly in social media. Besides, this article will also examine the Malaysian legal provisions relating to the contempt of faith that occurs particularly in the cyberspace. Generally, this study employs a qualitative method that uses a library-based approach and desktop review as the data sources are obtained through literature review from books, journal articles, related portals, cases, and observations from social media. The literature review aims to explain the legal provisions relating to contempt of religion of Islam and the spreading of ideology against Islam that threathening the faith of Muslim; while observations in social media are conducting to analyze the real scenario that happened in Malaysia. The study found that religious knowledge and awareness of the spread of ideology against Islam are very important to prevent Muslims from being deceived by the ideologies. Law enforcement could be the solution to this issue and can help to maintain the sanctity of Islam. - Some of the metrics are blocked by yourconsent settings
Publication Regulating Children's Safety On The Internet: A Malaysian Perspective(Zes Rokman Resources, 2017) ;Syahirah Abdul Shukor ;Hendun Abd Rahman ShahNurul Atira MusaThe recent case of pedophile, Richard Huckle has shocked the Malaysian nation on how fragile and dangerous when the Internet is being used to save abusive pictures and videos of children. Richard Huckle, a British citizen was charged in England for life sentence due to the charge for abusing Malaysian children during his visit to Malaysia. The shocking news became the front page of most local newspaper such as the Star and the New Straits Times have been actively reported on the danger of sexual pedophile based on their investigation. Hence, majority of the society feel, it is crucial to address new laws such as the sexual grooming laws to protect the vulnerable children on the Internet. In some countries such as Australia, United Kingdom and the United States of America have been addressing the issue of child protection on the Internet since the inception of the Internet in these countries. This paper aims to review the existing laws such as the Communications and Multimedia Act 1998, the Penal Code and the Action Plan for Child Protection of Children on the Internet (2015) issued by the Malaysian government to examine the loopholes in the law. Secondly, it explores good governance on the Internet by the state government in curbing child abuse on the Internet. This is because at the end of the day, it takes the whole community to raise and protect children, and it should not be seen as the state responsibility alone. Publication Victimization Of Children And Women On Social Networking Websites In Malaysia: A Legal Discourse(Zes Rokman Resources, 2017) ;Syahirah Abdul Shukor ;Nurul Atira MusaHendun Abd. Rahman ShahHollywood films with the titles “You’ve Got Email, “Identity Theft”, show us how the Internet has emerged and transcends into our daily activities. The Internet has been used as a medium of communication, making new friends and connecting with the old friends. It is unfortunate that the Internet has also become a place for abusive relationship even though sometimes the victims and perpetrators might not meet face to face. Cyberbullying, cyber harassment and cyberstalking are some of the reported incidents which are reported in daily newspaper. Thus, in some countries, new laws are being introduced to curb the problems of victimization online. Racism, gender, disabled and elder community can be one of the factors that lead to abuse and victimization. Thus, promoting safety is not sufficing, if no legal action is taken to curb and control the problem of victimization. A quick reference by using online search engine is made to daily local newspapers to identify the most reported cases related to Internet. Most of the existing literature on victimization of children and women on the Internet are derived from developed countries such as United States of America (USA) and United Kingdom (UK). This paper examines the reported cases of victimization online in relation to women and children in the Malaysian newspapers by examining news related to cyber pornography, cyberbullying, and cyber harassment. Identifying the most reported incident on the Internet is significant for future research as people especially children and women are prone to risk and danger on the Internet. Finally, this paper suggests that a continuous and a consistent strategic needed not only from the government, but also from the industry not only in order to create awareness among the public, but also and to curb the problem from becoming serious.
