Akibat dari itu maka timbullah pelbagai isu yang memberi kesan yang amat negatif kepada pihak-pihak yang terlibat khususnya ahli waris. Terdapat banyak faktor serta punca yang membawa kepada berlakunya keadaan ini; antaranya sikap acuh tidak acuh atau sambil lewa masyarakat dalam pengurusan harta pusaka milik mereka. Selain itu, ketidakfahaman masyarakat tentang kaedah dan cara serta prosedur yang perlu dilakukan untuk menguruskan harta pusaka juga merupakan faktor penyumbang kepada berlakunya isu harta pusaka yang tidak dituntut semakin bertambah di Malaysia. Keadaan ini tidak boleh dibiarkan dan perlu dicari kaedah dan mekanisma dalam menyelesaikan kemelut ini dari terus berlarutan. Artikel ini akan menfokuskan kepada perbincangan tentang punca-punca mengapa berlakunya isu harta yang tidak dituntut ini serta kaedah yang boleh diaplikasikan bagi membantu menyelesaikan dan mengurangkan masalah dalam isu harta yang tidak dituntut ini. - Some of the metrics are blocked by yourconsent settings
Publication The Management of Zakat Based on Fiqh of Darurat towards the Development of Islamic Digital Economy in Malaysia Post-Covid-19 Pandemic(Abdullah Kuzu, 2021)Setiyawan Bin GunardiThe Management of Zakat needs to be implemented progressively and innovatively in Era of Digital. Fiqh of Darurat plays an important role as a guide for zakat management towards the Islamic digital economy system in Malaysia. However, managing zakat post-the COVID-19 pandemic requires dynamic methods. Therefore, it’s necessary to study the appropriate method for managing zakat. This study aims to determine the management of zakat that needs to be carried out in the collection and distribution of the post-COVID-19 pandemic through the Fiqh of Darurat approach towards structuring the Islamic digital economy system with using descriptive qualitative methods. The results of the study found that zakat management can be carried out in any situation based on the Fiqh of Darurat after the transmission of the COVID-19 Pandemic through an online system. The law of paying zakat is still obligatory for the welfare of Muslims and the development of the Islamic economic system. - Some of the metrics are blocked by yourconsent settings
Publication Porcine DNA in Medicine toward Postpartum Patients from Medical and Islamic Perspectives in Malaysia(Indonesian Society for Knowledge and Human Development, 2021) ;Siti Nur Syahadah binti Mod AliSetiyawan Bin GunardiNowadays, the issue of the use of pig resources in medicine is a disputed Halal and Haram study. The widespread social media exposure of medicines containing pork in Malaysia has raised concern among many people, especially postpartum patients, who often be provided with porkbased medicine to prevent blood clots in the body. Most Malaysians still do not know the real action to take when faced with such a scenario. Thus, this study focuses on the purpose and requirements in using porcine DNA in postpartum patients according to the perspective of Medicine and Islam in Malaysia. This research methodology used qualitative methods through a library research approach by reviewing selected articles and interviews with physicians and Fiqh. The data collected were analyzed based on the principles of Maqasid Al-Shariah and Dharurah. By applying the principle “al-Darurat Tubih al-Mahzurat”, the results found that porcine DNA in medicine are allowed to use toward postpartum patients in Dharurat when there is no other option other than using drugs from haram sources. - Some of the metrics are blocked by yourconsent settings

It is well known that Almighty Allah would not send down a disease to His servants except that He sent down a cure for it. Therefore, the Islamic nations should follow the instructions and measures urged by the Islamic religion, or instructions issued by the competent health authorities to prevent this epidemic, especially since medical practitioners have not found any effective treatment to prevent the infection. Even though it has reached the level of vaccines, the transmission of infection has not been prevented. Therefore, these measures and instructions remain the mainstay of prevention and protection from it. This research aims to clarify the Shariah and medical preventive measures against the emerging coronavirus and study them as an analytical study from the perspective of Maqasid al-Shariah. To achieve this goal; the researcher followed the inductive and analytical approach, which consists in extrapolating and following the Shariah preventive measures from epidemics in general, and the Corona epidemic in particular, then analyzing and studying them in the light of Maqasid al-Shariah. The researcher concluded that among the Shariah measures to prevent epidemics and diseases are the following: quarantine, fleeing from lepers, avoiding handshakes, purification, placing a hand or a garment over the mouth when sneezing, fermentation of vessels and potting of pots, abstinence from immorality and disobedience, enjoining good and forbidding evil, and adherence to supplications and remembrances. Similarly, among the medical measures to prevent the corona epidemic are the following: taking care of hygiene, washing hands, using disinfectants, wearing masks and gloves, social distancing, and applying home quarantine for those infected with colds, avoiding direct contact with them, Sharia preceded modern medicine in devising physical and moral precautions to prevent epidemics and diseases.
