SafianThe emergence of products and services using Islamic attributes as the tool of marketing is increasing nowadays. Various Islamic terms have been used on the label, packaging, and also as the trademark of the products and services, for example, Air Terapi Al-Quran, Mi Cap Masjid, Jus Sunnah, Bekam Sunnah, Valet Doa and in some instances the Quranic frame being hanged on the wall in non-Muslim restaurants and many more. Islamic attributes has been manipulated as a tool for marketing products and services. This trend has led to many bad effects on the consumer and the dignity of Islam itself. Islam is a religion and shall not be exploited for product marketing, and there are needs for a mechanism to control this matter. This paper will analyse the meaning of Islamic attributes that were used in marketing in Malaysia and their effect on the consumers and Islamic dignity. Next, this article will look into the Islamic principles that can be adopted by the government in controlling the use of Islamic attributes in marketing via the principle of Siyasah Shar’iyyah to uphold the Maqasid al-Shari’ah, particularly Hifz al-Din (Protection of Religion). This paper is conceptual in nature and is of library-based research using primary and secondary data. The government should take serious action in controlling this matter. SafianHussein ‘Azeemi Abdullah ThaidiKemajuan teknologi masakini memberi impak besar kepada kesejahteraan hidup manusia. Antaranya membabitkan teknologi rawatan air sisa kumbahan yang mampu memproses air kumbahan menjadi lebih bernilai untuk pelbagai kegunaan seperti untuk pertanian, rekreasi, air minuman dan sebagai sumber tenaga baharu. Meskipun memiliki pelbagai kegunaan, namun, timbul persoalan hukum mengenai status air terawat dari sisa kumbahan, adakah ia boleh dimanfaatkan, memandangkan ia berasal daripada sumber air mutanajjis dan air mustakmal. Oleh itu, artikel ini bertujuan untuk menganalisis fatwa-fatwa berkaitan penggunaan air terawat dari sisa kumbahan, dalam aspek perubahan yang berlaku terhadapnya, daripada sifat asal air yang najis (mutanajjis) kepada mustakmal ataupun bersih (mutlak). Metodologi kajian ini berbentuk kualitatif, menggunakan kaedah pengumpulan data secara analisis dokumen terhadap fatwa-fatwa yang telah dikeluarkan. Dapatan kajian menunjukkan bahawa air sisa kumbahan yang telah dirawat, menurut fatwa, dikategorikan sebagai air yang suci lagi menyucikan (air mutlak), kerana berlakunya proses untuk menghilangkan najis dan mengekalkan semula sifat asal air yang suci lagi menyucikan. SafianMohamad Zaharuddin ZakariaE-wallet introduces a new trend for the financial services business landscape. E-wallet is characterized as a digital device that allows a user to conduct electronic transactions, but not restricted to only for purchasing but any activities involve in transfer and receive money. While many scholars focused on e-wallet awareness among people and banking industry which involved developed countries, there is not much literature discussed on prohibited element of Islam which is gharār in e-wallet contract. Furthermore, adapting the ewallet's sharī ͨ ah compliance is important as it will help to eliminate the doubt about using e-wallet particularly among Muslims users because every business in Muslims 'daily lives has to comply with the Qurān and Sunnah. This research thus aims to understand the element of gharār in e-wallet contracts. The questions posed are: 1) what is the origin concept of gharār in contemporary Islamic finance and transaction?; 2) how to identify e-wallet contracts involve with element of gharar?; 3) how to minimize the existence of gharar in e-wallet contracts?. The study will adopt qualitative methodology. In this research, the methodology used is a library research which is the researcher handling with mining data from document and content analysis. The expected findings for this study will enrich the literature regarding the element of gharār in online transactions. Publication An analysis on Islamic rules on drugs(Contemporary Research Center CRC Publications, 2013)Yasmin Hanani Mohd. SafianThe consumption of drugs for medication had been acknowledged by traditional Muslim jurists. However, when drugs were consumed for recreational purpose, the jurists started to dispute in this matter. This paper analyses the traditional Muslim jurists' attitudes (opinions) towards drug and examines their methodologies to determine the rulings of drug. This study finds that the jurists did not only rely on traditional analogy (qiyas) or conservative methods of deriving rules but some of them also conducted selfexperiment method to identify the effect of drugs. The study also finds that the classical jurist were divided into three groups, the first group totally permitted drugs, the second group allowed drugs that are consumed for necessity purpose and the last group banned drugs totally. - Some of the metrics are blocked by yourconsent settings

SafianBaby dumping case is a serious crime in Malaysia. The study is important to be conducted in order to discuss the suitable punishment with regards to this crime. It is not only confined to the legislations, but also to find the other preventive methods for the solution. In Malaysia, not only the laws are being used, but other preventive methods are also available such as the awareness, monitoring actions and baby hatch. This paper is to discuss the comparative study of the punishment and preventive methods available in Malaysia and some other countries. The method of this research is by using content analysis, under qualitative method, which the laws from various countries pertaining to baby dumping will be analyzed. Publication The Contribution Of Yusuf Qardawi To The Development Of Fiqh(University of Zurich, 2016)Yasmin Hanani Mohd. SafianThis paper analyses the contribution of a preeminent Muslim scholar, Yusuf Qaradawi to the religion, especially in the area of fiqh. His active role in disseminating the knowledge of fiqh began when he was 17 years old. His major works include The Lawful and Prohibited in Islam, Fiqh al-Zakat and Fiqh of Minority have greatly contributed to the progress of contemporary fiqh, putting him as one of the most influential Muslims in the world. He received many critical reviews over the years. Therefore, this paper analyses some of his fiqh works vis-à-vis the analytical reviews he received. It can be concluded that Qaradawi has made a considerable effort to exercise ijtihad corresponding to the current problems that is beneficial to Muslims worldwide. Publication Halal Governance In Malaysia Companies(Universiti Sains Islam Malaysia, 2020)Yasmin Hanani Mohd. SafianGovernance is an important component in Halal industry. Appropriate mechanism should be created to ensure the Halal certified company complies with the Shariah principles. Unlike Islamic finance, Halal industry is less regulated in term of governance. Halal certification is not compulsory and even Halal certificate holding companies do not have clear Shariah governance within the administration to ensure the company fulfil its duty and promise to the stakeholder and the customer. The establishment of proper Shariah governance framework for Halal industry will boosts confidence of the shareholders and the publics that all the practices and activities follow Shariah all the times. Thus, this study investigates current practice of Halal governance in several Malaysian companies. The internal mechanisme in Halal monitoring, controlling, improving and preventing any non-compliance will be assessed. The practice will then be compared to the practice of governance in Malaysian Islamic Financial institutions. The idea behind Halal and Tayyib services is to provide good quality and safe treatments that are not only beneficial for Muslims but for everyone, regardless of their beliefs. Thus, this paper aims to provide insights into halal and tayyib principles in cosmetic procedures. It is imperative to establish the principles because compliance with halal and tayyib principles will act as safe and ethical cosmetic services assurance. SafianFarkhatul LutviyatiSharia banks are financial institutions that are operationally different from conventional banks. People understand conventional banks better than Sharia banks. This research aims to determine the influence of knowledge, perception, promotion and community religiosity on interest in becoming Sharia bank customers in the people of Purwokerto City, Banyu as Regency. This research uses a quantitative method by determining the sample using a simple random sampling technique with a total of 400 respondents. The data for this research is regarded as primary data. The data collection method was carried out using a questionnaire. The data was analyzed using multiple linear regression analysis. This research variable consists of independent variables which include knowledge, perception, promotion and religiosity, as well as a dependent variable regarding people's interest in becoming Sharia bank customers. Partially, the variables knowledge, perception, promotion and religiosity have a significant positive effect on people's interest in becoming Sharia bank customers. Kajian ini akan mengkaji sejauh mana budaya setempat atau uruf ini boleh diterima pakai dalam isu pembahagian tanah adat khususnya di Negeri Sembilan. Dalam masa yang sama, kajian ini akan membincangkan syarat-syarat penerimaan uruf dalam pemberian harta pusaka berdasarkan nas al-Quran, Hadis dan pandangan ulama fikah serta dapatan temuramah. Kajian ini merupakan kajian kualitatif deskriptif yang menggunapakai kaedah analisa dokumen dan temubual berstruktur separa. Hasil kajian ini merumuskan bahawa perwarisan tanah adat adalah suatu praktis yang telah diamalkan sejak zaman berzaman di Negeri Sembilan mengikut adat Minangkabau tetapi perlu diselarikan dengan hukum syarak. Safian ;Syaza Azhari, ;Hussein Azemi Abdullah Thaidi,Muhammad Abdul Rahman SevanathanAir mutanajjis merujuk kepada gabungan di antara komponen air mutlaq dan najis yang menyebabkan perubahan pada sifat-sifat asal air iaitu; warna, bau dan rasa. Dalam konteks semasa, air sisa kumbahan yang terdapat di Loji Rawatan Kumbahan [LRK] boleh dikategorikan sebagai mutanajjis disebabkan ia bercampur dengan najis seperti tinja dan air kencing manusia. Permasalahan kajian adalah mengenai status air kumbahan yang telah dirawat dengan teknologi moden sama ada boleh dikategorikan sebagai air mutlaq atau tidak. Kajian ini bertujuan mengenalpasti mekanisma pembersihan air mutanajjis menurut fiqah dan menganalisa secara perbandingan dengan amalan rawatan air kumbahan yang terdapat di LRK milik Indah Water Konsortium [IWK]. Selain itu, menilai efluen terawat dan kesannya terhadap hukum taharah dalam Islam. Kajian ini menggunakan pendekatan kualitatif, dengan teknik kutipan data secara analisis dokumen dan pemerhatian di Loji Rawatan Kumbahan Serantau KL-Titiwangsa 2. Hasil kajian mendapati bahawa teknologi rawatan air kumbahan yang terdapat di LRK IWK telah mengaplikasi kesemua teknik pembersihan air mutanajjis yang disyorkan oleh fuqaha iaitu mukatsarah, nazh dan taghyir. Teknik-teknik tersebut mampu menukar status air daripada mutanajjis kepada mutlaq setelah ia memenuhi semua kriteria air mutlaq yang ditetapkan oleh fuqaha. Efluen terawat ini telah menyokong Matlamat ke-6 dalam Matlamat Pembangunan Lestari (SDG) iaitu air bersih dan sanitasi. Publication Perlaksanaan Ujian HIV Ke Atas Bakal Pengantin Di Negeri Johor: Satu Kajian Dari Sudut Undang-Undang Dan Syariah(Universiti Sains Islam Malaysia, 2005) ;Azman Ab Rahman ;Mushaddad Hasbullah ;Syed Salim Syed ShamsuddinYasmin Hanani Mohd. SafianThis study attempts to shed light on the implementation of the mandatory pre-marital HIV (Human Immunodeficiency Virus) testing on Muslim individuals in Johor and its effectiveness. This study also tries to trace the implications and consequences of the test upon the harrnonisation of Muslim family institutions specifically and the society at large, as well as to unveil the views of Syarac and Law on this issue together with its elaborations. The study adopts two kinds of methods. Firstly, library research which focuses on the collection of data from books, reports, statutes, enactments and others, both on the Islamic perspective and Family Law. Secondly, field research which denotes data collection through interviews with related authorities, either from the government or non-governmental organizations (NGOs), besides collecting feed backs and views fiom the state Muftis. The research discovered that the HIV pre-marital testing is only a mandatory and compulsory requirement in Johor, other states are still in the stage of planning and discussing the matter. The study also found out that Islam does not forbid the implementation of such testing for the sake of public interest. However, this study observed that the test is only compulsory to Muslim couples who wish to marry in Johor, which is based on the fatwa or religious decree on the issue made by the Johor Religious Council, without any legal enforcement binding it. Hence, this research is believed to be able to provide solutions to problems concerning human rights as well as to clear all doubts on the view of Islam and Law towards the pre-marital HIV test. Publication Shariah Attitude Towards Genetically Modified Foods: Aqli and Naqli Analysis(Universiti Sains Islam Malaysia, 2019)Yasmin Hanani Mohd. SafianGenetically modified (GM) food issue has sparked the debate, particularly in the Western world, on its detrimental effects to public health and the environment. Among the GM food producers and companies, the claim for intellectual property rights arise for food products and seeds for the technology they are licensing to farmers. For some Muslims and other God-conscious people, tampering with nature by implanting genes from one organism into another which nature has not sanctioned through natural processes and such legal claims is considered to be intolerable. The "terminator gene" introduced by the companies are likely to lead to monopoly and encroachment of the world agro-economics, predominantly held in the hands of conglomerates. This study examines the Shariah attitudes towards GM food using aqli and naqli approach analysis. The aqli approach used in this paper includes analysis of modern scientific research to determine the benefits and harms of GM food. The naqli approach includes examination of related legal evidences from Quran, Hadith and scholars view. SafianIslamic finance industry faces unprecedented new issues that need immediate attention by Shariah scholars. The issues require the Shariah scholars to exercise their own ijtihad whether it is a collective or an independent ijtihad especially in the innovations of Islamic finance. One of the main challenges in issuing a fatwa in the Islamic finance is the scholars have to innovate Shariah compliant products that are workable and meet the modern market needs. To address this issue, it requires the scholars to have mastery skills in both the turath (classical knowledge) and contemporary knowledge in Islamic finance. SafianMuda, M.Small and Medium-Sized enterprises (SMEs) play an important supportive role in &e Malaysian economy. This research examines their perception towards the Islamic banking products offered by Islamic banking institutions. A total of 180 SMEs from the Federal Teritory of Kuala Lumpur, Selangor and Negeri Sembilan had been surveyed based on self-administered questionnaire. The results indicate that majority of the SMEs still do not consider the Islamic banks as the most desirable financia1 institution. The less effective marketing strategy has been identified as one of the reasons contributing to the low acceptance of products offered. There are many issues and challenges that arise in Halal logistics that require a solution in order to maintain the stability of the Halal industry in a Halal status. Fatwa and the views of Islamic scholars play an important role in a solution to this problem. Therefore, Halal logistical issues and challenges need to be resolved through a guide based on Fatwa analysis as a comprehensive reference. This study aims to reveal the issues and challenges of Halal logistics in the Halal industry sector. Also explains the fatwas and views of Islamic scholars that can be used as guidelines in guaranteeing Halal products so that they remain Halal. The logistical issues and challenges collected will be studied through a qualitatively descriptive of document analysis approach from the study of the journal and local newspaper papers, as well as looking the fatwas issued by the Malaysian fatwa institution will be analyzed to provide a solution. The results of the study concluded that the issues and challenges that occur in Halal logistics can be resolved through a fatwa analysis approach and the views of scholars. The method of preaching used by the preachers to teach the rulings and regulations in Islam related to halal and haram (prohibited and permissible) was not in accordance with the method of taysir. It has led to a negative perspective of Islam that made the Indigenous People feel sceptical and afraid to embrace Islam. They were afraid that it would affect their lifestyles. This taysir method of Halal and Haram is believed as a better alternative to approach Indigenous People in Malaysia. This qualitative research is conducted to examine the hurdles and obstacles Indigenous People faces to embrace and practice Islam, especially in practicing the rule of halal and haram by using the library�s reference method. The research also aims to overcome the problems by suggesting a new approach of preaching by considering the method of taysir Previous research found that the new model of taysir halal and haram could be successfully applied by including: (1) The diversity of schools of fiqh, (2) Methods of Islamic Principles especially on darurah, (3) The discussion of rukhsah, (4) The priority of fiqh al-awlawiyyat, and (5) Maqasid al-Syariah together with it.
