Kajian ini dijalankan bagi memperkenalkan beberapa kaedah sains forensik yang boleh digunakan sebagai keterangan alternatif selain daripada pengakuan salah dan saksi bagi kes-kes LGBT. Kajian kualitatif ini menggunakan kaedah sosio-perundangan dan kajian kepustakaan dalam mengumpulkan data primer dan sekunder. Kemudian, kaedah analisis kandungan telah diaplikasikan dengan menggunakan pendekatan penalaran induktif dan deduktif untuk menganalisa data-data tersebut. Hasil kajian menunjukkan bahawa liwat dan musahaqah adalah sebahagian daripada kesalahan jenayah syariah di Malaysia. Kajian juga mendapati terdapat beberapa kaedah sains forensik yang boleh digunakan sebagai keterangan alternatif termasuklah analisa DNA, analisa bahan bukti fizikal, biologi, kimia, dan analisa peranti digital. Kajian ini mencadangkan agar aspek pembuktian bagi kes-kes LGBT dalam konteks undang-undang Syariah dan juga Hukum Syarak perlu diberikan penekanan kerana kajian yang sebegini masih belum ada dijalankan oleh pengkaji-pengkaji lepas. - Some of the metrics are blocked by yourconsent settings

The criminal justice system faces the dilemma when children break the law, as children are considered as minors who are not legally responsible for their actions. In most cases, the society tend to focus on protecting children from neglect, abuse or harms but often overlooked of protecting children who are involved in harming or causing injury to other people or cause damage to property. It is equally important to address the growing concern on children‘s exposure to usage of the Internet. Thus, the question such as, can the child‘s wrongs on the Internet be considered as a de-linquent act, namely possible wrongful acts conducted by children that would otherwise be an offence if committed by an adult, is ex-plored. The legal status and minimum age of criminal responsibility in Malaysia are also examined. In addition, the Shariah views will be discussed briefly. Then, the paper explores the problems and challenges face by children in using social media websites. Finally, the paper suggests that the government and the community in particular parents and teachers have vital roles to play in ensuring that the poli-cies and rules provide mechanism not only to protect children but also to empower them as a citizen of the country. Publication Comparison Between Dispute Resolution Mechanisms In International Law And Islamic Law: Problems And Challenges In The Realisation Of The International Islamic Court Of Justice(Faculty of Syariah and Law, Universiti Sains Islam Malaysia, 2022-10-27) ;Mohamad Kamal Sodiqin Abdull ManafHendun Abd Rahman ShahAt present, there are several dispute resolution mechanisms that are available to resolve disputes between states. International law regards all states to be standing at an equal footing that makes state consent to be required in the dispute resolution process. Meanwhile, Islamic law presents dispute resolution as one tenet to achieve justice which is in line with the Shariah and the Prophet Muhammad (pbuh) traditions. This article will describe and analyse the dispute resolution mechanisms in international law and Islamic law by focusing on the distinctive traits between these two. This is needed in order to evaluate suggestions on how to ensure the establishment of the International Islamic Court of Justice (IICJ) as a convenient forum for dispute resolution among Muslim States that was proposed by the Organization of Islamic Cooperation (OIC) in 1981 but has not been materialised until today. Using qualitative method and library-based research, primary and secondary sources from various sources are examined to provide a comparative analysis on the concept of dispute resolution in international law and Islamic law. The preliminary findings from this study suggest that in order to properly established the IICJ as a medium of settling the difference of views among the Muslim states, it must be encouraged that all Muslim states must ratify the Court’s Statute. The OIC must organise inclusive dialogues to explain the working of the Court particularly to its member states to make it workable in resolving disputes and achieve considerable results in preserving peace as well as securing justice between Muslim states. - Some of the metrics are blocked by yourconsent settings

Despite these challenges, Muslim communities in general have been consistent in preserving the religious precepts derived from the primary sources of Al-Quran and Al-Sunnah, which form the foundation of the Islamic identity. Although widely underemphasised, futures thinking is deeply ingrained in the precepts of Islamic thoughtsince the time of Prophet Muhammad (pbuh), which unbeknownst to many,hasindubitably shaped the transformation not only in Muslim communities, but has also influenced global shifts in civilisation from multifarious aspects, for example, science and technology, arts, governance and social justice.This paper seeks to illustrate the significance of Islamic futures thinking as a foundation for progress in Muslim communities, by applying the qualitative methods of content analysis and engagements in focus group discussions. To this end, the study analysesdata obtained from the exploration of Islamic texts, traditions and literatures on the Islamic perspectives of futures thinking. This paper advances the propositionthat futures thinking has a profound basis in Islam due to the universal nature of the Islamic concepts of knowledge, the methods of addressing gradual and imminent change, its constant inspirations towards excellence and a justly balanced society, as well as Islamic ethics in foresight. Kertas kerja ini bertujuan untuk mengkaji sejarah perkembangan undang-undang tanah adat di Negeri Sembilan khasnya yang keseluruhannya diadaptasi daripada perbilangan adat. Tumpuan utama dalam perbincangan kertas kerja ini merangkumi undang-undang yang berkaitan dengan sistem tanah Adat Perpatih seperti perlembagaan, Kanun Tanah Negara, Enakmen Pemegangan Tanah Adat dan juga Akta Pengambilan Tanah. Kajian yang dibuat adalah berdasarkan penyelidikan kepustakaan dan juga hasil temubual dengan beberapa individu yang terlibat secara langsung dengan tanah adat. Konklusi kertas kerja ini menggariskan pemahaman berkenaan perkembangan dan isu perundangan berkaitan tanah adat di Negeri Sembilan sejak zaman penjajahan hingga ke hari ini. Adat perpatih which is based on matrilineal lineage forms the main structure of the administration of customary land in Negeri Sembilan. This paper aims to to study the development of customary land law in particular the state of Negeri Sembilan, which is generally derived from customary sayings/idioms (perbilangan adat). The main focus of discussion in this paper comprises of the laws relating to customary land law in Adat Perpatih such as the Federal Constitution, National Land Code, Customary Tenure Enactment and the Land Acquisition Act. This study applies library based research and interview of relevant key individuals who are directly involved in customary land law. Hak hadhanah telah dikaji para imam mazhab dan undang-undang keluarga Islam di Malaysia yang dijadikan sebagai rujukan di mahkamah syariah. Oleh itu, kajian yang terperinci perlu dilakukan bagi mendapat maklumat awal berkaitan hadhanah mengikut kehendak syarak. Objektif kajian ini bertujuan mendedahkan hak hadhanah menurut perspektif mazhab Shafie dan mazhab Hanafi, dan dari aspek undangundang keluarga Islam di Malaysia. Kajian ini menggunakan kaedah kepustakaan terhadap dokumendokumen fiqh mazhab Hanafi dan Syafii. Analisis turut dilakukan terhadap undang-undang tersebut di Mahkamah Syariah di Malaysia. Akta-akta dan enakmen undang-undang keluarga Islam dalam memainkan peranan menyelesaikan kes hadhanah ini turut dianalisa. Kajian mendapati bahawa hak hadhanah lebih diberikan pihak wanita, kerana wujudnya kasih sayang dan kelembutan hati dalam menjaga kanak-kanak sehingga mampu mengurus diri sendiri. Publication Juxtaposition Of Right To Self-determination And Terrorism Under International Law(Universiti sains Islam Malaysia, 2023) ;Farzanah Selamat ;Hendun Abd Rahman ShahNorfadhilah Mohamad AliThe right to self-determination is one of the jus cogenslaws under international law, which denotes the legal right of people to decide their political, economic, and social affairs within the borders of a territory. This right essentially grants the people, to some extent a legal right to use force in exercising their right to self-determination. The national liberation movements (NLMs) for example, whose rights and struggle for independence havelong been recognised by international law, in many instances have been conflated with the act of terrorism. One of the reasons is the absence of a universally accepted definition of terrorism. This paper aims to investigate how the conflation of NLMs as terrorists has affected the exercise of the right to self-determination. The study analyses relevant legal laws and juristic opinions on the issues at hand using a qualitative approach via library-based methodology. The result of this study reveals that, despite having provisions for countering international terrorism, due to the absence of a universally accepted definition of terrorism, the current international counterterrorism law is influenced by state municipal lawsas the crime of terrorism is outside the jurisdiction of the International Criminal Court. Some states used their liberal power to define and designate NLMs as terrorist organisations which have allowed them to misuse municipal law against such movements. In short, whilst the use of force in exercising the right to self-determination is governed by international humanitarian law, the lack of a universally accepted definition of terrorism enables States to label NLMs as terrorists, criminalising the liberation movement as a whole. - Some of the metrics are blocked by yourconsent settings
Publication Legal Adaptation Of The Crime Of Maritime Piracy And Its Elements From The Perspective Of International Law(Usuli Faqih Research Centre, 2021) ;Fatima Mohamed Abdulqader Baqais ;Norfadhilah Mohamad Ali ;Hendun Abd Rahman ShahSyaryanti HussinThe article deals with the legal conditioning of the crime of maritime piracy and its elements from the perspective of international law, and the article also aims to define the crime of maritime piracy, highlight its seriousness, indicate its legal adaptation, find its pillars a crime and the penalties prescribed for it, and clarify the position of international law on the phenomenon of maritime piracy, analyzing and evaluating the role of international conventions in suppressing piracy. In order to achieve the objectives of the research, the researcher relied on the descriptive analytical approach as it is the best approach in adapting the crime of maritime piracy, stating its elements, and identifying all the elements that distinguish it from the acts that may follow it, and analyzing the topic by shedding light on the position of international law. Among the most important results it was found that the crime of maritime piracy has many definitions, but all of them agree that what distinguishes it is the gravity of the acts that compose it, which prompted its legal criminalization, and that the Geneva Convention on the High Seas of 1958 and the United Nations Convention on the Law of the Sea of 1982 did not set an accurate definition of the crime of maritime piracy. It confined itself to mentioning its component acts, and among the most important recommendations was drafting a new international agreement or amending the United Nations Convention on the Law of the Sea to include rules for defining the crime of maritime piracy, approving penalties for its perpetrators, and setting international cooperation rules that oblige all countries, under pain of penalties, to provide what is necessary and what is available to them of Information regarding this crime. - Some of the metrics are blocked by yourconsent settings
Publication Legal And Regulatory Challenges Of Halal Certification: Insights From Cosmetic Manufacturers On Halal Built-in Implementation(Human Resource Management Academic Research Society, 2022) ;Yuhanza Othman ;Muhammad Nizam AwangHendun Abd Rahman ShahThe halal built-in concept assures that the whole cosmetic manufacturing process complies with the halal requirements and all related aspects of safety, cleanliness, efficacy, and quality. However, the challenges faced by cosmetic manufacturers in halal cosmetics will undermine the effectiveness of the halal built-in concept. This study will examine the legal and regulatory challenges cosmetic producers experience in complying with halal requirements throughout cosmetic production. To achieve the objective, this study adopted a qualitative method in which data were collected through interviews with twelve halal-certified cosmetic manufacturers and two industry experts. This study found that halal cosmetic manufacturers encounter challenges in getting halal raw materials, dealing with unsupportive suppliers, maintaining halal during production, and preparing documentation for the halal application. This study will enlighten suppliers, competent authorities, and the government on the efforts taken by halal cosmetic manufacturers to maintain the halal certification of the products so that it helps reduce all obstacles. - Some of the metrics are blocked by yourconsent settings

University of Malaya was the only premier law school in Malaysia during that time. Gradually, the number of law schools increased and now legal education is available in a number of both private and public universities in Malaysia. The landscape of legal education differ post 2008 when new law schools from public universities were made subject to a review conducted by the Legal Profession Qualifying Board (LPQB) – failure to obtain full recognition will result in students from the universities concerned, having to sit for Certificate in Legal Practice (CLP) examination. In the light of this development, legal education in Malaysia has become under strict scrutiny by the legal fraternity, and thus it is a question of what reasonable expectation should the country set on the legal education provided by universities. This article will address legal education from the point of view of universities, the relevance of the CLP examination and the level of skills and knowledge required to produce ‘practice-ready’ graduates. The discussion also considers the availability of the 9-months pupillage before admission to the Malaysian Bar and other criteria for education as provided for by the Malaysian Qualifications Agency (MQA). The issue of apostasy, atheism, agnotisme, liberalism, and various ideologies which are against the true Islamic teaching have spread and threatened their beliefs and faith. Therefore, this article aims to reveal the reality of this threat among Muslims, particularly in social media. Besides, this article will also examine the Malaysian legal provisions relating to the contempt of faith that occurs particularly in the cyberspace. Generally, this study employs a qualitative method that uses a library-based approach and desktop review as the data sources are obtained through literature review from books, journal articles, related portals, cases, and observations from social media. The literature review aims to explain the legal provisions relating to contempt of religion of Islam and the spreading of ideology against Islam that threathening the faith of Muslim; while observations in social media are conducting to analyze the real scenario that happened in Malaysia. The study found that religious knowledge and awareness of the spread of ideology against Islam are very important to prevent Muslims from being deceived by the ideologies. Richard Huckle, a British citizen was charged in England for life sentence due to the charge for abusing Malaysian children during his visit to Malaysia. The shocking news became the front page of most local newspaper such as the Star and the New Straits Times have been actively reported on the danger of sexual pedophile based on their investigation. Hence, majority of the society feel, it is crucial to address new laws such as the sexual grooming laws to protect the vulnerable children on the Internet. In some countries such as Australia, United Kingdom and the United States of America have been addressing the issue of child protection on the Internet since the inception of the Internet in these countries. This paper aims to review the existing laws such as the Communications and Multimedia Act 1998, the Penal Code and the Action Plan for Child Protection of Children on the Internet (2015) issued by the Malaysian government to examine the loopholes in the law. Secondly, it explores good governance on the Internet by the state government in curbing child abuse on the Internet. This is because at the end of the day, it takes the whole community to raise and protect children, and it should not be seen as the state responsibility alone. Perintah Kawalan Pergerakan (PKP) semasa krisis pandemik Covid-19 telah menyebabkan peningkatan konflik keluarga dan kes perceraian yang tinggi dalam kalangan masyarakat Malaysia. Artikel ini bertujuan mengkaji prospek dan cabaran dalam pelaksanaan proses mediasi dalam Majlis Sulh (sulh-mediasi) secara dalam talian di mahkamah Syariah sebagai satu norma baharu. Kajian menumpukan kepada aspek perundangan dan amalan di Mahkamah Syariah. Kaedah penyelidikan yang digunakan adalah kajian kualitatif dengan pendekatan kajian kepustakaan, tinjauan literatur dan analisis kandungan. Dapatan kajian menunjukkan bahawa walaupun sesi sulh-mediasi secara dalam talian mempunyai cabaran dari segi penggunaan teknologi, sosial dan perundangan namun ia mempunyai prospek yang besar bagi penyelesaian pertikaian secara perdamaian. Publication مواجهة التهديدات الإيرانية بإغلاق مضيق هرمز في ضوء أحكام القانون الدولي(Usuli Faqih Resources, 2021-04) ;Saeed Salem Khalifa Salem Almazrouei ;Hendun Abd Rahman Shah ;Nor Fadhilah Mohamed AliMualimin Mochammad SahidThis research aims to study the application of the principles of international law relating to Iran's threat to the closure/blockage of the Strait of Hormuz through using the descriptive and analytical method. This research will highlight the importance of the Strait of Hormuz for international navigation, especially after the discovery of oil in the Persian Gulf. Respecting freedom of navigation in the strait is provided in the transit passage provision, as a principle established in international law. This is crucial to ensure continuous and expeditious passage of ships across the strait without barriers or stops. The international law also stipulates the rights and obligations to which coastal states are bound to follow, in accordance to Article 41 of the 1982 United Nations Convention for the Law of the Sea (UNCLOS). The provision provides that coastal states may designate sea lanes and prescribe traffic separation schemes for navigation in straits.
