The science of maqasid is very important especially in understanding and interpreting the Islamic texts. Maqasid syariah generally aims to preserve the five basic necessities of human life, namely preserving religion, life, intellect, lineage (as well as dignity) and property. Any effort that supports these five necessities (maslahah) and protects them from harm (mafsadah) is included in the goals of Islamic law. The concept of maslahah and mafsadah has always been the main backbone for the scholars in determining the law. During the pandemic COVID-19 hit in Malaysia, various legal rulings have been issued by the authorities at the state and federal levels to protect the affairs of Muslims. The rulings are issued after considering the maslahah and mafsadah to be faced by Muslims in Malaysia. This study was conducted to identify the role of maslahah and mafsadah in influencing the Syariah rulings related to pandemic COVID-19 in Malaysia as well as showing how the process takes place (takyīful fiqhī). This study is qualitative, using a library approach to collect primary and secondary data and then analyse it by content analysis. The results show that the principles of maslahah and mafsadah play a big role in determining the Syariah rulings in the COVID-19 pandemic situation as well as the need to set a clear standard of maslahah and mafsadah so that the rulings produced are accurate, precise and not made it on whim. - Some of the metrics are blocked by yourconsent settings
Publication Analisis Peranan Ulil Amri Dan Pihak Berkuasa Agama Dalam Menentukan Polisi Umum Berkaitan Hukum-Hakam Di Malaysia: Kajian Terhadap Isu-Isu Semasa Pandemik Covid-19(Faculty of Syariah and Law, Universiti Sains Islam Malaysia, 2020-10-27) ;Lukman Abd Mutalib ;Wan Abdul Fattah Wan Ismail; ;Abdul Manan Ismail ;Mohd Soberi Awang ;Setiyawan Gunardi ;Siti Fatimah SallehMuhammad Hazim AhmadObeying Ulil Amri is one of the things demanded by the Islamic law as long as the injunction is in order to protect the maslahat and prevent mafsadah from happening to the people. Since the onset of the COVID-19 pandemic in Malaysia, several public policies have been developed by Ulil Amri covering various aspects including social, economic, and Islamic religious affairs in Malaysia. Each policy formed is the result of discussion after discussion with authoritative bodies as well as experts in various fields. This study was conducted with the aim of identifying Ulil Amri who is responsible for handling and managing COVID-19 pandemic issues. In addition, this study was also conducted to identify the role and job scope of each Ulil Amri involved in formulating the public policies related to the COVID-19 pandemic. This qualitative study has collected relevant data through primary and secondary documents and further analysed them using the content analysis method. The results of this study found that several ministries involved in the construction of public policies related to Syariah rulings in Malaysia include the Yang di-Pertuan Agong, the National Security Council, the Ministry of Health Malaysia, the Minister in the Prime Minister’s Department, and the State Council of Islamic Religion. They are the Ulil Amri who is responsible for handling and managing COVID-19 pandemic issues related to Islamic religious affairs in Malaysia. Each Ulil Amri involved has his own role and jurisdiction. They will work together in formulating any public policy related to Islamic religious affairs. This shows that every public policy produced involves various parties from various fields who work together to safeguard the maslahat and prevent mafsadah from happening to the people. - Some of the metrics are blocked by yourconsent settings

Cabaran yang dihadapi murid dalam pembelajaran tahfiz boleh menjejaskan pencapaian hafazan dan mengganggu proses pembelajaran mereka. Oleh itu, sokongan daripada beberapa pihak sangat diperlukan bagi membantu murid tahfiz menghadapi cabaran tersebut. Selaras dengan realiti itu, maka kajian ini dijalankan untuk meneroka bentuk cabaran dan sokongan yang diperlukan oleh murid tahfiz yang berada di sekolah agama bantuan kerajaan terpilih di Malaysia. Pendekatan kualitatif digunakan bagi menjawab persoalan kajian yang ditentukan iaitu berkisar kepada penerokaan secara mendalam terhadap cabaran dan sokongan yang diperlukan oleh murid tahfiz. Teknik persampelan bertujuan digunakan bagi memilih peserta kajian yang terdiri daripada murid tahfiz yang telah melalui pembelajaran tahfiz sekurangkurangnya tiga tahun. Temu bual mendalam dijalankan terhadap peserta kajian yang melibatkan 11 orang murid tahfiz. Dapatan kajian menunjukkan bahawa terdapat beberapa cabaran pembelajaran tahfiz yang dihadapi oleh murid iaitu cabaran persekitaran rumah, cabaran kesukaran menghafaz, cabaran gajet dan cabaran rakan sebaya. Seterusnya dapatan juga menunjukkan bahawa terdapat beberapa sokongan yang diperlukan oleh murid tahfiz iaitu sokongan guru, ibu bapa, rakan dan sekolah. Kajian ini memberi implikasi penting bahawa sokongan adalah aspek yang signifikan kepada murid tahfiz agar mereka mampu menghadapi cabaran dalam pembelajaran mereka. Pihak guru, ibu bapa, rakan sebaya dan pihak sekolah perlu berperanan sebagai sistem sokongan yang efisien bagi membantu pencapaian hafazan murid tahfiz khasnya dan pembelajaran akademik amnya. - Some of the metrics are blocked by yourconsent settings

Kini setelah hampir genap satu tahun, sejak wabak tersebut mula dikesan di Wuhan, China, WHO dalam laporan terkininya menyebut bahawa sudah hampir 50 juta orang di seluruh dunia telah dijangkiti dengan virus maut tersebut dan lebih daripada satu juta jiwa telah menemui ajal. Hal ini, telah mempengaruhi soal kesihatan, keselamatan, sosial, ekonomi, isu-isu berkaitan amalan keagamaan atau ibadah dan hal-hal berkaitan kehidupan yang lain, yang menuntut masyarakat dunia dengan kepakaran dan kemampuan yang ada dalam pelbagai bidang berganding bahu untuk keluar dari kebuntuan yang dihadapi. Bagi yang berkecimpun dalam bidang akademik, khususnya dalam bidang syariah tidak ketinggalan perlu turut berusaha bagi memposisikan diri dalam menyelesaikan kebuntuan berkaitan isu-isu berbangkit, ekoran daripada situasi tersebut. Kajian yang berbentuk teoritikal ini, bermatlamat menjelaskan asas dan keperluan fiqh pandemik kepada masyarakat Islam masa kini, agar kehidupan mereka sentiasa di dalam lingkungan batas syariah. Metodologi yang digunakan dalam artikel ini adalah kaedah kajian kualitatif dalam meneliti pandangan ulama-ulama klasik dan kontemporari bagi merumuskan bahawa keperluan terhadap fiqh pandemik dan praktisnya dalam masyarakat masa kini. Pandemik bukanlah perkara baru dalam sejarah ketamadunan manusia, terutamanya sejarah awal Islam. Sumber sejarah Arab yang berkaitan dengan pandemik ini tertumpu dalam bentuk naratif dan kronologi yang dikhaskan untuk topik hawar al-ṭāʿūn. Naratif ini kemudiannya membentuk genre religio-legal, yang disebabkan oleh kemunculan semula malapetaka ini hingga akhir abad kesembilan belas. Kesusateraan Arab ini penting bukan hanya sebagai sumber kronologi hawar al-ṭāʿūn, ianya juga menjadi bukti keprihatinan berterusan para ulama Muslim dalam membahaskan hukum-hakam sama ada untuk setuju atau tidak dengan prinsip-prinsip agama yang berkaitan dengan sesuatu wabak atau pandemik. Melalui kajian ini, para penyelidik berusaha untuk mengenal pasti persamaan antara pandemik COVID-19 dan pengalaman umat Islam generasi sebelumnya, dan untuk mengekstrak beberapa maklumat penting yang dapat digunakan sebagai tindak balas umum dan praktikal terhadap pandemik tersebut. Kajian ini memfokuskan secara khusus pada generasi para sahabat Nabi dan peradaban Muslim terdahulu yang tercatat dalam buku-buku sejarah Islam yang terkenal. Kajian kualitatif ini telah menggunakan kaedah penyelidikan dokumentari untuk mengumpulkan data yang relevan dari dokumen terkemuka. Kemudian, data yang dikumpulkan dianalisis menggunakan analisis kandungan kualitatif. Kajian ini menemui tujuh jenis wabak yang terkenal dalam sejarah Islam iaitu al-Ṭāʿūn Syīrawaih, al-Ṭāʿūn ʿAmwās, al-Ṭāʿūn al-Jārif, al-Ṭāʿūn al-Fatayāt, al-Ṭāʿūn Rajab, al-Ṭāʿūn di Kufah, dan al-Ṭāʿūn al-ʿĀm atau al-Kabīr. Istintaj dari sejarah di sebalik bencana ini menghasilkan enam langkah yang dilaksanakan oleh masyarakat Islam pada masa itu yang dapat digunakan sebagai tindak balas umum dan praktikal terhadap wabak tersebut. Enam langkah tersebut ialah perintah kawalan pergerakan, menjalankan syura secara kolektif dengan pelbagai pihak, perlaksanaan kuarantin, penjarakkan fizikal dan pengharaman perhimpunan besar-besaran, menziarahi mayat yang dijangkiti penyakit berjangkit, dan hawar al-ṭāʿūn dikategorikan maraḍ al-makhūf. Selain itu, keenam-enam tindakan ini dengan jelas mematuhi prinsip-prinsip Islam dan juga sejalan dengan kehendak Syariah yang lebih tinggi dalam menjaga kebajikan umat Islam dan mencegah mereka dari sebarang bahaya, terutama terhadap ancaman pandemik. - Some of the metrics are blocked by yourconsent settings

Publication Minat Murid Yang Mengikuti Aliran Tahfiz Dan Bentuk Sokongan Yang Diterima(Global Business Entreprenueurship, 2017) ;Norlizah Che Hassan ;Fathiyah Mohd Fakhruddin ;Ahmad Fauzi Mohd Ayub ;Lukman Abd MutalibWan Marzuki Wan JaafarPendidikan Aliran Tahfiz adalah antara aliran pendidikan yang semakin mendapat tempat dalam kalangan rakyat Malaysia masa kini. Selaras dengan ini, maka kajian ini dijalankan bertujuan untuk mengenal pasti profil murid yang mengikuti Tahfiz dengan meninjau minat murid dan sistem sokongan yang diterima terutamanya daripada pihak ibu bapa, sekolah dan guru. Seramai 411 orang murid Tahfiz dari empat buah sekolah menengah aliran tahfiz terlibat sebagai sampel kajian. Antara profil murid yang ditinjau ialah jantina, jumlah juzuk yang dihafal, pernah mengikuti ujian tilawah, minat terhadap Tahfiz dan bentuk sokongan. Dapatan kajian mendapati terdapat beberapa bentuk sokongan yang diterima daripada ibu bapa, sekolah dan guru. Kajian ini memberikan implikasi jelas bahawa pendidikan Tahfiz bukanlah suatu aliran yang mudah dan memerlukan penglibatan ibu bapa, sekolah dan guru yang boleh membantu murid-murid menghadapi pengajaran dan pembelajaran tahfiz mereka dengan baik. Kajian ini juga diharap dapat memberikan maklumat yang berguna kepada semua pihak yang berkaitan. Tahfiz education streaming is gaining popularity among Malaysians today. In line with this, this study was conducted purposely to identify the profile of Tahfiz students by surveying the students' interest and support received mainly from their parents, schools and teachers. A total of 411 students from four medium Tahfiz schools involved in the study. Among the students’ profile surveyed is gender, the number of constituents who memorized, frequent number of exam recital, interest and form of supports. Findings of the study found there is some form of support from parents, schools and teachers. The study provides the clear implication that Tahfiz education is not a simple streaming and requires the involvement of parents, schools and teachers that can help students cope with tahfiz learning and perform well in their teaching and learning. Mutakhir ini tamadun manusia sedang diuji lagi dengan penularan pandemik COVID-19. Wabak ini telah menjangkiti jutaan manusia daripada seluruh pelosok dunia serta memakan banyak nyawa. Wabak seperti ini adalah persis penularan wabak yang telah berlaku dan direkodkan dalam lintasan sejarah Islam sejak dari zaman Rasulullah s.a.w. Wabak yang kerap berlaku dalam sejarah Islam adalah wabak taun. Musibah ini telah meragut ribuan nyawa umat Islam pada waktu itu. Kajian ini dilaksanakan untuk melihat bagaimana kerangka fiqh pandemik terbina berdasarkan kepada peristiwa penularan wabak dalam sejarah Islam, mengeluarkan mutiara hukum dari peristiwa tersebut dan menghubungjalinkannya dengan maqasid syariah. Kajian kualitatif ini telah mengumpulkan data yang relevan melalui dokumen primer dan sekunder dan menganalisanya menggunakan kaedah analisis kandungan. Hasil kajian ini mendapati bahawa taun adalah penyakit berjangkit atau wabak yang seringkali menular dalam sejarah Islam. Terdapat beberapa siri penularan wabak taun yang telah direkodkan dalam lintasan sejarah Islam sejak dari zaman Rasulullah (s.a.w.). Ramai umat Islam termasuklah para sahabat (r.a.) meninggal dunia akibat daripada jangkitan wabak taun tersebut. Selain itu, hasil kajian juga menunjukkan bahawa terdapat beberapa istintāj hukum diperoleh daripada amalan dan tindakan yang dilaksanakan oleh Rasulullah (s.a.w.) serta para sahabat (r.a.) dalam mendepani wabak taun ini. Seterusnya, istintāj tersebut mempunyai hubungan rapat dengan konsep maqasid syariah dalam memenuhi kemaslahatan serta menghindari umat manusia daripada sebarang kemudaratan. It demands discipline, hard work and commitment from students. In Malaysia, tahfiz education is one of the mainstream educations offered and is in high demand among parents. Past studies showed that there was a problem in completing the Quranic memorization among tahfiz students. Furthermore, previous studies showed that studies on tahfiz were not focusing on the aspect of student learning engagement, so there is a need to explore such aspect. This qualitative study focused on the student learning engagement of tahfiz students. Specifically, this study aimed to explore the aspects of student learning engagement of tahfiz students. In-depth interview was the method of data collection used in this study. Twelve tahfiz students and six tahfiz teachers were involved as the research participants. Data found that there were three aspects of student learning engagement. Three aspects of student learning engagement are related to emotional, cognitive and behaviour aspects. The emotional aspect of student learning engagement comprised of the patience and interest of the tahfiz students in their learning. The cognitive aspect covered on the capability of determining goals that they wanted to achieve, able to plan their study time and depicting their diligence and focus in learning. Meanwhile the behaviour aspect of student learning engagement referred to students’ eagerness to participate in school activities that are in conform with their tahfiz learning. This study clearly stressed on some significant implications for tahfiz students, teachers and the school itself to focus on this learning engagement among students to assist their journey on tahfiz learning. The roles of parents, teachers and the students themselves were also emphasized in this study in order to promote tahfiz students learning engagement. The establishment of Tahfiz schools by government and private sector is a clear sign that Tahfiz education will start to fill mainstream education in Malaysia. In line with this, the study is conducted to explore the characteristics of Tahfiz students and to understand what the main criteria of admission for Tahfiz schools are. This article aims to review and analyze the criteria being used to select Tahfiz students. This study is a qualitative research and eight students from three Tahfiz schools were randomly selected as research respondents. The findings showed several important criteria for the admission to tahfiz schools. The entry requirement would require the applicants to go through several important interviews. Among the criteria evaluated by the interviewers are the ability to recite the Quran with correct pronunciation of tajweed, memorizing abilities, academic excellence, student interests and attitudes. The findings provided important implications that are important for Tahfiz schools to have a clear standard in selecting their students. This will help school and parents, especially in training and preparing their children for Tahfiz school entrance in order to produce more huffaz (those who memorize the entire Qur’an).
