Peratusan peningkatan anak tak sah taraf ini bukan hanya berlaku di kalangan orang bukan Islam, bahkan ia juga berlaku di kalangan orang-orang Islam. Kesan anak tak sah taraf sangatlah besar kerana ia bukan setakat melibatkan hak perwalian yang menentukan sah atau tidak sesuatu perkahwinan bahkan ia berkaitan dengan hak pewarisan. Walau bagaimanapun terdapat perbezaan dari segi konsep anak tak sah taraf antara perundangan Islam dan peruntukan sepertimana yang diguna pakai oleh Jabatan Pendaftaran Negara (JPN). Perbezaan ini memberi kesan yang amat signifikan sama ada dari segi hukum dan juga tanggapan masyarakat terhadap istilah anak tak sah taraf itu sendiri. Kertas kerja ini akan memfokuskan kepada konsep anak tak sah taraf menurut perundangan Islam dan juga menurut peruntukan undang-undang yang diguna pakai oleh Jabatan Pendaftaran Negara (JPN). Maklumat yang diperoleh dalam kertas kerja ini hasil kajian perpustakaan dan temu bual pakar agama, pakar perundangan, JPN dan juga pemilik pusat-pusat jagaan wanita-wanita yang terlanjur. Selain itu kertas kerja ini juga akan membincangkan faktor dan penyelesaian terhadap isu anak tak sah taraf di kalangan orang Islam di Malaysia. Diharapkan dengan memahami faktor atau penyebab peningkatan anak tak sah taraf di kalangan orang Islam, akan terbit satu solusi yang tuntas bagi menyelesaikan permasalahan anak tak sah taraf yang membarah dalam kalangan orang Islam khususnya di Malaysia. - Some of the metrics are blocked by yourconsent settings

Penyelesaian seharusnya dilihat dari akar umbi selaras dengan pendekatan yang diterapkan oleh al-quran dan al-hadith. Artikel ini menganalisis faktor penyumbang kepada kadar kelahiran anak tak sah taraf dalam kalangan masyarakat Islam di Malaysia. Kajian telah ini menganalisis faktor-faktor penyumbang kepada kelahiran anak tak sah taraf menggunakan metodologi temu bual dan analisis dokumen. Secara keseluruhannya, terdapat tujuh tema utama faktor-faktor yang mempengaruhi bilangan kelahiran anak tak sah taraf antaranya ialah, faktor keluarga, agama, pendidikan, rakan sebaya, teknologi, perasaan semula jadi, dan pergaulan bebas. Dapatan kajian ini memperincikan sub-faktor bagi faktor-faktor utama yang seharusnya ditekankan dalam menangani permasalahan ini. Makalah ini kemudiannya mengutarakan solusi bagi faktor-faktor tersebut melalui al-quran dan al-sunnah. Sungguhpun begitu, keterlibatan remaja-remaja Islam di Malaysia dalam perkara-perkara yang meruntuhkan sahsiah seperti seks bebas merupakan suatu perkara yang amat membimbangkan dan perlu dipandang serius oleh semua pihak. Kenyataan ini bukanlah satu lontaran kosong untuk menakutkan mana-mana pihak semata-mata, bahkan ia disokong oleh bukti-bukti penyelidikan yang telah dibuat oleh pelbagai pihak. Persoalannya, apakah faktor-faktor yang menyumbang kepada keruntuhan sahsiah remaja Islam di Malaysia? Oleh itu, kertas kerja ini akan membincangkan faktor-faktor yang telah menyumbang kepada remaja Islam terjebak dengan perkara-perkara yang meruntuhkan sahsiah. Selain itu, penyelidik juga turut mencadangkan beberapa cadangan yang boleh dibuat bagi mengurangkan kes-kes sebegini. Kertas kerja ini akan menggunakan kaedah kualitatif iaitu melalui kaedah analisis dokumen dan kaedah temu bual dengan beberapa pusat perlindungan dan responden-responden yang terpilih di Malaysia. Hasil kajian mendapati terdapat beberapa faktor yang telah menyebabkan remaja Islam terjebak dengan perkara-perkara yang meruntuhkan sahsiah. Faktor-faktor yang dimaksudkan ialah kurang didikan agama, kegagalan institusi rumah tangga, tahap pendidikan yang rendah, dorongan rakan sebaya, teknologi yang berleluasa dan pergaulan bebas. Publication From Rights To Women's Rights: Malaysian Experience(Universiti Sultan Azlan Shah, 2021)Nik Salida Suhaila Nik SalehThis paper explores the philosophical idea of human rights to consider the meaning of the term ‘rights’. There are huge amounts of work being done in defining the term ‘rights’. ‘Rights’ is defined by most human rights scholars in a four-separate perspective, as a claim, immunity, a freedom and a power. These concrete meaning of ‘rights’ might be revealed from Hohfeld’s idea of ‘rights’ that may be used in a rigid sense of the right-holder’s claim to something with a correlative duty. The emergence of a new consciousness of the patterns of discrimination against women and a rise in the number of organizations committed to combating the effect of such discrimination in 1960s, called the Government of Malaysia to show its support not only by setting up organisations, but also by allocating funds. However, there are critiques that justice for women is impossible to be upheld in Malaysia because the Government reserves few articles of the United Nations Convention on the Elimination of All Forms of Discrimination against Women due to its inconsistencies with Shariah. Publication Improving Mathematical Interest Among Muslim Primary School Students Via SITIC(Universiti Sains Islam Malaysia, 2017) ;Khairunneezam Mohd Noor ;Nik Salida Suhaila Nik Saleh ;Nur Fazidah Asmuje@AsmuziAmirah ZainunThis article focused on the focal aim of analysing students’ perceptions in regards to their interest in Mathematics before and after they implement SITIC, a combination of Silat and mental arithmetic skills. A group of Muslim students (N=84) were selected from three primary schools in the district of Nilai, Negeri Sembilan on the basis of snowballing strategy. The students were exposed to 6 sessions of SITIC in a period of 2 weeks with the supervision of their teachers. A set of questionnaire was developed to look into the students’ interest towards mathematics before and after they join SITIC’s sessions. The findings shown that the interest of the respondents in their particular learning subjects increased after it was combined with interesting activities in SITIC. Therefore, they need to be polished and shaped with the best mold to produce an ideal and quality model in the future. Even so, the involvement of teenagers with things that undermine their morals such as free sex is becoming more prevalent and increasing day by day. This statement is not an empty throw to intimidate any party alone, in fact, it is supported by research evidence that has been made by various parties before. This study aims to identify the causes of the problem of moral decay among Muslim adolescents in Malaysia and some proposed solutions to reduce this issue. This study has used a qualitative approach through document analysis method and interview method with several selected transit centers in Malaysia, namely Rumah Generasiku Sayang, Sekolah Tunas Bakti Marang, and Taman Seri Puteri Kuching. Study respondents consisted of government and non-government shelter advisors, medical social work officers, religious advisors, shelter advisers, school principals school supervisors, and study participants consisting of shelter students themselves. For qualitative analysis, these interviews were translated verbatim. The study found that there are several main causes that cause Muslim adolescents in Malaysia to be stuck with this issue such as lack of religious education, troubled families, low educational values, widespread technology, and peer influence discussed in detail in this study. Publication Jurisdictional Conflicts In Facing Covid-19 Pandemic: An Analysis Of Hibah Cases In Negeri Sembilan Syariah Courts(Faculty of Syariah and Law, Universiti Sains Islam Malaysia, 2020-10-27) ;Amylia Fuziana Azmi ;Nik Salida Suhaila Nik SalehMohamad Zaharuddin ZakariaIn 2020, statistic reveals that a total number of 30 hibah cases have been registered in the Negeri Sembilan Syariah Courts. Interestingly, the total number of cases registered this year has decreased as compared to 51 cases for the previous year. This study analyses on the jurisdictions of the Syariah Courts in deciding hibah cases in Negeri Sembilan by taking into a consideration the recent outbreak of Covid-19. This study investigates the impacts of the Covid-19 pandemic on the number of hibahcases brought before the Syariah Courts in the state of Negeri Sembilan. For this purpose, this study applies a doctrinal legal approach where the data collection is based on a library-based research and the statistical data collected from Negeri Sembilan Syariah Courts. Analysis was done on several important cases concerning the jurisdiction of the courts. This study discovers that the Covid-19 pandemic has an effect on the number of registered and resolved cases pertaining to hibah in Negeri Sembilan Syariah Courts. This study recommends that electronic method such as e-proceeding to be fully implemented so as to enable the public to access the court easily. It is hoped that findings of this study will shed light on the issue of jurisdictions concerning hibah and beneficial in providing clear and precise information on the jurisdiction of the Syariah Courts in deciding hibah matters. - Some of the metrics are blocked by yourconsent settings

Without proper monitoring and education from parents and family, adolescents are exposed to acts that can destroy their personality, such as engaging in adulterous activities. Therefore, this study was conducted to describe the family factors that contribute to adultery among Muslim adolescents in Malaysia. Adopting a qualitative method, 12 research participants were interviewed. The researcher used semi-structured interviews, which involve the flexibility of interviewswith open-ended questions. The data obtained from the interview were then analyzed to obtain the results of the study. The findings of this study show that there are several family factors that have contributed to adultery. These factors are the divorce of parents, lack of communication between parents and children, excessive restrictions, lack of religious education, adulterous family, drug use and, the most serious of all, the family’s exploitation of adolescents for prostitution. These findings also indicate that the basis for the formation of the Islamic family institution in Malaysia needs to be re-examined and monitored as well as possible in order to provide a safe environment for adolescents and, in turn, avoid adultery. - Some of the metrics are blocked by yourconsent settings

Childcare services should not be thought of as should not be considered as mere care services but rather it is the key foundation for young children's education. According to practice in Malaysia, home childcare centres that care for less than four children do not need to register with the authorities and are not monitored by any laws or regulations. The issue of home childminders who are not regulated by specific laws is crucial to be highlighted in an effort to improve the quality of childcare services in Malaysia through legislative efforts. Hence, the purpose of this research is to examine the legal requirements for regulating home child care centres. Highlights of incidents and cases involving home day care are analysed to see the extent to which children's safety is exposed to the risk of danger as a result of the absence of specific laws to supervise home childminders. This study was conducted using the method of doctrinal research in the form of data collection based on document analysis and case reviews. These legal requirements are the structural quality features which are translated into laws and regulations. One of the requirements that often neglected is the physical environment. This paper examines the question on whether the physical environment feature is an important legal requirement that necessitate improvements in the legislative framework of Malaysian child care. The importance of physical environment is explained by referring to the previous studies and research. Then, the laws and regulations in Malaysia involving Child Care Centre Act 1984 and Child Care Centre Regulation 2012 are evaluated according to the relevant sections and regulations.Recommendations are then made for Malaysia to improve its laws and regulations regarding physical environment based on research and practices from Malaysia itself and other jurisdictions as benchmarks. Similar treatment might not have a value of neutrality because, once the right to equality is related to and enforced by laws, its objectivity and impartiality can be challenged. The Malaysian government is making progress towards a safer and more equal environment for women and girls following the proposed new or amended legislation. These includes the anti-stalking law, the Sexual Harassment Act, and ending child marriage. Furthermore, the establishment of a Select Committee on Rights and Gender Equality in Parliament have been considered as a good step forward for equality. Indeed, implementation of policies such as childcare facilities in government offices as well as encouraging the private sector to follow suit are good moves towards creating more opportunities and encouraging the participation of women in the workforce. This paper explores the conceptual understanding of ‘equality’ globally and from the perspective of Islamic jurisprudence. This reflection is in line with Islamic belief that needs to reform the understanding of society based on the suggestion of Al-Quran and Islamic scholars. With this interpretation, this paper will explore Malaysia’s progress in empowering women and gender equality. Firstly, this paper explores previous studies which prove the importance of high quality child care towards the children development. The discussion will further explore various views and paradigms on the concept of quality in child care especially on the important traits of quality child care. Referring to the wide practice of experts in child care, the common categorization of quality aspects which are process quality and structural qualities is also discussed further. Next, the determinants of quality child care from structural features are examined. This discussion will, later on, engage on arguing that accreditation too shall be a vital indicator in ensuring all the quality elements of high quality child care centres are adequately observed by child care providers. This will later bring the discussion on the instruments which are compatible in measuring child care quality. Later on, this paper touches on the relationship of regulation and quality exploring on how structural aspects may be translated into regulations with the aim to enhance child care quality. Namun sejak akhir-akhir banyak laporan dari media massa dan elektronik menyatakan bahawa kadar remaja-remaja Islam yang terlanjur di Malaysia amatamat membimbangkan. Dalam kajian ini, penulis akan membincangkan berkenaan punca yang menyebabkan remaja di Malaysia terlanjur. Hasil kajian mendapati bahawa, adalah sangat penting untuk memahami punca kepada kerosakan remaja pada hari ini demi membendung kepada masalah yang lebih besar. Hasil kajian ini juga menunjukkan bahawa antara punca-punca yang menyebabkan remaja terlanjur iaitu antaranya atas sebab kurangnya didikan agama, kurangnya pemantauan daripada ibu bapa dan pengaruh rakan sebaya. Kajian ini menggunakan kaedah kualitatif dengan mengumpulkan data daripada sumber-sumber primer dan sekunder yang kemudiannya dianalisis dengan menggunakan analisis dokumen dan kaedah temu bual di beberapa pusat perlindungan yang terpilih dengan mengkaji punca-punca yang menyebabkan remaja Islam di Malaysia terlanjur. The discussion touches on the feasibility of making international comparisons in child care settings, in order to enhance the quality of child care settings in terms of laws and regulations. Experiences from other countries are scrutinised here in order to take lessons from these countries. Looking into child care in the prisms of international perspectives will assist Malaysia in improving and developing the Malaysian child care, specifically on laws and regulations. The paper aims to present experiences from other countries, which can be a valuable reference for Malaysia to work on improving the Malaysian child care legislative framework.
