    Isu kelahiran anak tidak sah taraf masih belum selesai. Penyelesaian seharusnya dilihat dari akar umbi selaras dengan pendekatan yang diterapkan oleh al-quran dan al-hadith. Artikel ini menganalisis faktor penyumbang kepada kadar kelahiran anak tak sah taraf dalam kalangan masyarakat Islam di Malaysia. Kajian telah ini menganalisis faktor-faktor penyumbang kepada kelahiran anak tak sah taraf menggunakan metodologi temu bual dan analisis dokumen. Secara keseluruhannya, terdapat tujuh tema utama faktor-faktor yang mempengaruhi bilangan kelahiran anak tak sah taraf antaranya ialah, faktor keluarga, agama, pendidikan, rakan sebaya, teknologi, perasaan semula jadi, dan pergaulan bebas. Dapatan kajian ini memperincikan sub-faktor bagi faktor-faktor utama yang seharusnya ditekankan dalam menangani permasalahan ini. Makalah ini kemudiannya mengutarakan solusi bagi faktor-faktor tersebut melalui al-quran dan al-sunnah. Kajian lanjutan perlu dilakukan menerusi pelbagai medium dan metodologi bagi mengisi beberapa kelompangan yang telah dijumpai semasa kajian ini dilakukan.

    Remaja merupakan aset yang amat penting bagi menjamin kemajuan dan kekuatan sesebuah masyarakat dan negara. Justeru itu, golongan remaja ini perlulah digilap dan dibentuk dengan acuan yang terbaik untuk melahirkan satu model yang ideal dan berkualiti pada masa akan datang. Sungguhpun begitu, keterlibatan remaja-remaja Islam di Malaysia dalam perkara-perkara yang meruntuhkan sahsiah seperti seks bebas merupakan suatu perkara yang amat membimbangkan dan perlu dipandang serius oleh semua pihak. Kenyataan ini bukanlah satu lontaran kosong untuk menakutkan mana-mana pihak semata-mata, bahkan ia disokong oleh bukti-bukti penyelidikan yang telah dibuat oleh pelbagai pihak. Persoalannya, apakah faktor-faktor yang menyumbang kepada keruntuhan sahsiah remaja Islam di Malaysia? Oleh itu, kertas kerja ini akan membincangkan faktor-faktor yang telah menyumbang kepada remaja Islam terjebak dengan perkara-perkara yang meruntuhkan sahsiah. Selain itu, penyelidik juga turut mencadangkan beberapa cadangan yang boleh dibuat bagi mengurangkan kes-kes sebegini. Kertas kerja ini akan menggunakan kaedah kualitatif iaitu melalui kaedah analisis dokumen dan kaedah temu bual dengan beberapa pusat perlindungan dan responden-responden yang terpilih di Malaysia. Hasil kajian mendapati terdapat beberapa faktor yang telah menyebabkan remaja Islam terjebak dengan perkara-perkara yang meruntuhkan sahsiah. Faktor-faktor yang dimaksudkan ialah kurang didikan agama, kegagalan institusi rumah tangga, tahap pendidikan yang rendah, dorongan rakan sebaya, teknologi yang berleluasa dan pergaulan bebas. Diharapkan dengan pendedahan awal mengenai faktor-faktor yang menyumbang kepada keruntuhan sahsiah remaja Islam di Malaysia, kes-kes sebegini akan dapat dikesan dan dibasmi lebih awal oleh semua lapisan masyarakat di Malaysia.

    Short Message Service’ or ‘SMS’ (Short Message Service) is an online method of communication. Now not only ‘SMS’, even various other forms of online communication arise such as such as WhatsApp, Telegram, Messenger WeChat, Instagram and many others. In addition to providing convenience in the relationship even though the distance is thousands of miles, 'SMS' also has an impact on the law in certain cases. Among the questions that arise is the acceptance of hibah made by ‘SMS’ for those suffering from COVID-19 at the level of Maraḍ al-Mawt according to Islamic law. This article explored the concept of ‘SMS’ as an electronic document and its power in proof in a grant-related case by a COVID-19 patient in a Maraḍ al-Mawt situation. In addition to tracing the concept of Maraḍ al-Mawt and its conditions according to fiqh and legislation, this article will also link it to COVID-19 and ‘Terminal Disease’ according to modern medicine. This article will indirectly answer the legal question about the necessity of making hibah by COVID-19 patients in Maraḍ al-Mawt condition.

    Agenda pelaksanaan hukuman alternatif yang berorientasikan pemulihan pesalah jenayah syariah perlu diberi perhatian sewajarnya kerana sehingga kini tidak diketahui sejauh mana ia dilaksanakan di bawah sistem perundangan syariah negara. Agenda pemulihan inijuga sepatutnya dijadikan sebagai salah satu agenda bagi memperkasakan sistem perundangan syariah negara atau Mahkamah Syariah itu sendiri. Perlu difahami bahawa matlamat hukuman dalam Islam bukanlah sekadar menghukum pesalah, tetapi yang paling utama adalah memastikan pesalah tersebut berjaya dipulihkan. Pelaksanaan program pemulihan mestilah berdasarkan perancangan yang teliti agar bentuk pemulihan yang bersesuaian dapat diberikan berdasarkankepadakesalahan atau jenayah yang dilakukan. Keterbatasan danketidaktahuan tentang sejauh mana kesesuaian dan mekanisme pemulihan pesalah jenayah syariedi bawah sistem perundangan negara pada masa kini membuka persoalan tentang sejauh mana pesalah-pesalah ini mendapat hak mereka untuk dipulihkan dan seterusnya mendapat keadilan. Keadaan ini sepatutnya menjadi desakan kepada pihak berwajib untuk mengambil langkah yang sewajarnya untukmengkaji dan menanganinya. Dalam kajian ini, penyelidik telahmenggunakan kaedah kualitatifbagimerungkai permasalahan tersebut serta mencadangkan penambahbaikan terhadap beberapa aspek yang dilihat penting sebagai langkah awal ke arah pelaksanaan hukuman alternatif yang lebih tersusun di Mahkamah Syariah. Kajian mendapati bahawa aspek pemulihan pesalah adalah salah satu matlamat utamahukuman dalam Islam dan aspek yang berkaitan dengan matlamat tersebut tidak boleh diketepikan begitu sahaja. Kajian ini juga mendapati bahawa hukuman alternatif berorientasikan pemulihan yang diaplikasikan di Mahkamah Syariah pada masa ini adalah amat kecil skopnya dan masih ‘kabur’dari segi pelaksanaannya berbanding di Mahkamah Sivil. Oleh itu, perbincangan mengenai perkara ini diharapkandapat membuka mata pihak-pihak berkaitan agar dapat memberikan perhatian yang serius dan mengambil tindakan yang drastik untuk melihat dan mengkaji aspek pemulihan pesalah jenayah syariah sedia ada supaya penambahbaikan dapat dilakukan.

    A cross-border marriage is any type of marriage that takes place outside of the country by utilizing the services of a matchmaker in that country. However, the number of cross-border marriages has recently increased significantly. It is impossible to prevent this problem from occurring in the future. This is because those who want to marry across borders will do so for a variety of reasons. If the cross-border marriage is not registered upon return to Malaysia, it has a variety of consequences for the wife, children, and even family members. Therefore, this study aims to clarify the concept of cross-border marriage, including its definition and some factors that encourage couples to marry in this manner. This study used a qualitative approach to obtain concrete data by conducting semi-structured interviews with stakeholders who manage marriage governance for Muslims in Malaysia. The findings show, cross-border marriage is any type of marriage made abroad or through a specific syndicate, and there are several main factors that encourage couples to marry cross-border. The desire for polygamy, did not get family permission, reluctance of the couple to follow the marriage procedure, lack of exposure to the marriage procedure in Malaysia, couples who have been together, and the easy way to get married are among the main factors of cross-border marriages. We hope that this study will provide appropriate exposure to Malaysia's Muslim community about this issue and that all parties will play an important role in addressing this issue so that such cases can be reduced.

    The study aims to clarify the nature of the problems of implementation in criminal judgments, and to indicate its types. Statement of the position of the UAE legislator and other legislation regarding the problems of implementing penal provisions; Clarification of the legal reasons for the emergence of problems of implementation in penal judgments; And a statement of the most important conditions that must be met in the case of problematic implementation and the competent authority to consider it. The problem of the studyis the legal or judicial obstacles that impede the implementation of criminal rulings. Which leads to the suspension of implementation procedures, which impedes the progress of execution cases in the courts, increases their number and overcrowding, and prolongs the period of litigation, which impedes access to the required criminal justice behind the implementation of these rulings. Thus affecting the course of the lawsuit and the penal litigation. The descriptive analytical method was applied as the method that aims to clarify everything related to this topic. In addition to the comparative approach to clarify the vision of some legislation in some laws such as the UAE and Egyptian law. Jurisprudential opinions and controversial topics were reviewed and commented on. In addition to reviewing judicial applications related to the subject of the study. The study indicated that the UAE legislator has stipulated directly and clearly the jurisdiction of the court that issued the ruling to consider the problem in its implementation, whether it was issued by the criminal or civil courts regarding penal rulings; The study showed that the UAE legislation and other comparative legislation did not show the procedures for raising implementation problems in detail, as it dealt with methods of appeal. Therefore, the general rules are referred to in cases where there is no text; The study also revealed that the effects of the ruling on the problem after adjudicating it is a right decision for one of the parties to the problem case

    The arrivals and protracted presence of asylum seekers and refugees in Malaysia have been met with policies largely shaped by humanitarian approaches leading to inconsistent responses and impasse in achieving durable solutions to refugee dilemmas. This qualitative study using the method of desk review of materials such as books, journals and newspaper articles identifies the human rights protection framework for asylum seekers and refugees and the problematic implications and challenges for both refugees and the host country, Malaysia, due to the absence of a formal refugee protection framework at the national level. Despite gaps in and outdated nature of the 1951 Refugee Convention relating to the Status of Refugees, it calls for refugee legal protections to be based on a legal and governance framework rather than non-binding aspirations and ad hoc approaches. The latter has proved adverse to both the interests of the host state and refugee communities. The findings indicate that the impacts on denial and violation of the rights and protections of refugees across political, social and economic terrains are accompanied by risks to Malaysia’s public security and interests. The study concludes with several early recommendations on the need to firstly recognise the legal status of refugees in Malaysia and the urgency to design an adequate protection and governance framework complemented with a system of shared responsibility to protect and manage refugees who have been in protracted limbo for an average of 20 years, if not more, without durable solutions to their plight.

    The world population is ageing. According to data from World Population Prospects: the 2019 Revision, by 2050, one in six people in the world will be over age 65 (16%), up from one in 11 in 2019 (9%). Meanwhile, empty-nest syndrome is a psychiatric condition that affects elders, who encounter feelings of grief, disappointment, anxiety, failure, difficulty in changing their responsibilities, and change in parenting as children leave their parents' home. In 2020, 10.3% estimated population aged 60+ years and above are vulnerable to 'empty-nest' syndrome in Malaysia. This is due to several factors such as living alone or being left by their children. This syndrome causes them to feel sad and become stressful and even worse, suffers from mental or physical health problems. Previous research and statistics proved that 29.9% of older people may have empty nest syndrome as a result of living alone or with just their spouse without the presence of child in 2014. The numbers has increased years after. Therefore, this preliminary analysis will discuss how shariah address empty nest syndrome among senior citizens in Malaysia as majority of Malaysian are Muslims. This qualitative study uses inductive and deductive approaches to obtain general and specific conclusions of primary and secondary data sources. The findings from this analysis show that there are several solutions that have been clearly stated in the Qur'an and al-Sunnah on empty nest syndrome. Indeed, Islam emphasizes a comprehensive solution not only from one side but also from various parties such as family, community or neighborhood, as well as the ruler or government who will ensure that the current proposed solution is more convincing and effective. This study suggests for further research to be conducted to solve empty-nest issue among elderly citizen as Malaysia is moving towards ageing population in 2030.

    This study aims to identify the use of one of the well-known maxims in the field of jurisprudence, which in the Islamic jurisprudence method means "the judgement on something based from his perception," in some research papers submitted to the committee of the Muzakarah Mufti Malaysia. This library qualitative research includes the analysis of the opinions of mufassirs (exegetes of the Quran) and jurists regarding this rule. The analysis was conducted on websites, several committee meetings, research papers, and judgement decisions that were presented to the Muzakarah committee to find out the extent of using this rule in the committee. The results of the study proved that this method is already used in conducting research and preparing research papers that are presented to the committee. Instructions from experts and study visits are always conducted to obtain a clear public perception of an issue before the Muzakarah committee makes any decision or fatwa.

    Remaja merupakan aset negara yang identitinya mesti dipupuk supaya selaras dengan pembangunan dan tuntutan negara yang bertamadun. Kualiti dan ketahanan generasi muda negara dalam memimpin masyarakat ke arah jalan yang benar menentukan kemakmuran masa depan sesebuah negara. Namun sejak akhir-akhir banyak laporan dari media massa dan elektronik menyatakan bahawa kadar remaja-remaja Islam yang terlanjur di Malaysia amatamat membimbangkan. Dalam kajian ini, penulis akan membincangkan berkenaan punca yang menyebabkan remaja di Malaysia terlanjur. Hasil kajian mendapati bahawa, adalah sangat penting untuk memahami punca kepada kerosakan remaja pada hari ini demi membendung kepada masalah yang lebih besar. Hasil kajian ini juga menunjukkan bahawa antara punca-punca yang menyebabkan remaja terlanjur iaitu antaranya atas sebab kurangnya didikan agama, kurangnya pemantauan daripada ibu bapa dan pengaruh rakan sebaya. Kajian ini menggunakan kaedah kualitatif dengan mengumpulkan data daripada sumber-sumber primer dan sekunder yang kemudiannya dianalisis dengan menggunakan analisis dokumen dan kaedah temu bual di beberapa pusat perlindungan yang terpilih dengan mengkaji punca-punca yang menyebabkan remaja Islam di Malaysia terlanjur. Oleh itu, kajian ini mengharapkan pihak-pihak yang berkenaan terutamanya ibu bapa boleh mengambil usaha yang sepatutnya bagi membendung masalah ini.

    The main objective of this study is to explore an important method of punitive treatment within correctional institutions (prisons) through which the disciplining, rehabilitation and reform of the convicts can be achieved. The punitive action ceased to bepainful, and it no longer has anything to do with determining the type of freedom-depriving punishment. Using the descriptive analytical approach, the study explored the purposes of punitive work as one of the modern punitive treatment methods whose purpose is to discipline, rehabilitate and reform. The study took into account that punitive work has a key role in rehabilitating the convict, as it either helps him to master the profession he used to practice before entering prison, or it pushes him to learna new profession consistent with his inclinations and desires. In addition, giving the inmate a remuneration makes him discover the value of himself as a human being and his role in satisfying his needs. This work is organized and regulated, not contracts of employment or contracting contracts concluded between the penal administration and the convicts, and the results of data analysis showed that punitive work within the correctional and penal institutions today is one of the most important methods of other modern punitive treatment, which all together lead to an effective contribution to the rehabilitation and reform of the convicts The study found that there are several goals that can be achieved through the punitive work method within the correctionalinstitution, including the rehabilitation purpose of the convicts, in addition to the other purposes of maintaining order within the penal institution, in addition to the economic purpose whose impact is reflected not only on the convict, but also to the whole community. Thus, the study concluded that punitive work is a right of the convict that requires him to take advantage such as obtaining the appropriate wage for him, obtaining rest, determining the maximum working hours and the obligation to compensate those who are injured because of it from those convicted in work accidents and occupational diseases, and that the convictalso has the right to choose work that matches his inclinations and his desires and abilities, and also concluded that punitive work in penal institutions develops talents and abilities, generates self-confidence, self-esteem and responsibility, brings satisfaction and instilsa love of work and familiarity with it.

    Recently, the use of documents has significantly increased among the general public and the national government. This is attributed to the robustness of documents, which serve as evidence in various daily matters such as administrative affairs, transactions, marriage, debts, and more. Their effectiveness as evidence has made them the preferred choice over other forms of proof. However, challenges arise when presenting documentary evidence, including the risk of forgery and ensuring the authenticity of documents submitted as evidence in court proceedings. This study focuses on the issue of document forgery by elucidating the definition of document forgery and its stance in Islam, the legal rulings regarding document forgery under the jurisdiction of the Malaysian Syariah Court, and the reported cases in the Malaysian Syariah Court concerning the crime of document forgery. The researcher adopted a qualitative approach to achieve the study's objectives. The findings indicate that document forgery is one of the challenges when presenting documentary evidence in court. Under the jurisdiction of the Syariah Court, there are no specific provisions for the crime of forgery in general; instead, it is treated as contempt of court. Furthermore, based on the analysis of cases involving document forgery, the penalties imposed by the court are minimal and ineffective for the accused. Therefore, the Malaysian Syariah Court needs to examine the practices of civil law attorneys when dealing with cases related to document forgeryand analyze the rulings under which they are adjudicated. This will enable Syariah attorneys to better handle such cases in the future.
