Abstract
Porcine based blood thinners namely low molecular heparin (LMWH) drugs are known to be highly potential to prevent the life-threatening event cause by blood clotting or Venous Thromboembolism (VTE). However, its usage was clearly prohibited according to The Muzakarah (discussion) Committee of the National Council for Islamic Religious Affairs of Malaysia (MCMKI) / JAKIM National Council decision in 2009. Yet, LMWH usage is considered permissible for treatment purposes for critically ill patients in the life-threatening stage/darurah stage. The halal alternative of LMWH, Fondaparinux is recommended to replace LMWH even though the animal derivative-free blood thinner drug has an inadequate / unstable safety profile for pregnant and postpartum women. The MCMKI’s decision to allow exemption of LMWH usage in emergency condition (sighah) creates confusion when prescribed to pregnant and postpartum women. Thus, it has made LMWH a less favorable choice due to the dilemma between its usage and the exceptions in the MCMKI’s statement. This study used qualitative methodology through document analysis techniques and interviews. Twenty-one expertise consisting of ten medical consultants from three departments, namely seven obstetricians and gynaecologists (O&G), a cardiovascular specialist, a hematologist and a family physician. On the other hand, three senior pharmacists and eight shariah experts among muftis and academicians from the public universities were interviewed for this study. The findings of the study revealed that pregnant women undergone physiological changes in which their blood easily clots, and some easily develop massive clotting event (Venous Thromboembolism or VTE) and can be fatal. LMWH is the best preventative medicine for VTE condition, and it should be used during pregnancy and postpartum for those who at risk. Thus, based on the justification of fiqhiyyah methods such as Al-Darar Yuzal and Al-Hajah Tunazzal Manzilah Al-Darurah, the usage of LMWH is permissible from fiqh perspective upon pregnant and postpartum mothers who are indicated.
