Sejarah akan mencatat musibah ini sebagai musibah terbesar abad 21 yang telah mengubah struktur kehidupan manusia yang belum pernah berlaku sebelum ini. Pelbagai cabaran dialami manusia semasa musibah berlaku dan bermula lah apa yang dikenali sebagai norma baharu dalam hidup manusia sama ada secara individu mahupun masyarakat. Sebagai agama yang Syamil (lengkap) dan salih likulli zaman wa makan (sesuai dengan segala zaman dan tempat), ajaran Islam (Syarak) menjadi panduan yang dapat digunapakai dalam mendepani segala cabaran era baharu dan memberi jawapan (solusi) bagi isu-isu semasa Pandemik Covid-19. Artikel ini membincangkan aplikasi prinsip-prinsip (kaedah) fiqh yang digunapakai sebagai panduan dan jawapan pelbagai persoalan yang dihadapi masyarakat. Kajian ini menggunakan metodologi kajian kualitatif iaitu menggunakan kajian perpustakaan dengan menganalisis dokumen primer dan sekundar seperti kitab rujukan (turath), serta penulisan akademik di dalam jurnal dan artikel. Dapatan kajian menunjukkan bahawa prinsip ajaran syarak yang terhimpun dalam kaedah fiqh menjadi rujukan dalam menentukan sesebuah hukum isu-isu yang berlaku. Ini menjadi bukti bahawa keanjalan hukum syarak mampu mendepani pelbagai isu semasa yang sentiasa berubah. Prinsip thawabit (yang kekal tidak berubah) dan mutaghayyirat (yang berubah) tetap diambil kira sebagai satu dasar rujukan dalam hukum hakam syarak. - Some of the metrics are blocked by yourconsent settings

Publication Child's Lineage Al-Li'an (Oath of Condemnation) and his Inheritance Rights: A Comparative Study Between Islamic and Malaysian Law(USIM Press, 2021) ;Azziz Raouane ;Ruhi Fadzlyana Jailani ;Mualimin Mochammad SahidMushaddad HasbullahThe lineage of al-li`an child and his inheritance from his father, who denied him and performed oath of condemnation (al-mula’anah) is considered one of the crucial issues in the Sharia and the law. This is because of the serious effects of denying his lineage from his father, which leads to depriving the child of the inheritance of the father and his family. Some courts accepted the analysis of the DNA when denying the child's lineage. Based on this fact, the issue has raised, especially when there is a conflict between the father’s denial of his son and the court’s finding based on DNA result. Which one is to be accepted if the father denied while the court confirmed his child’s lineage? This study aimed at introducing al-li`an child from Sharia and legal points of view, and the importance of analyzing the genetic footprint (DNA) as a guide to be used when there is a conflict between husband and wife in their opinions. The research methods used in this study are the inductive approach by tracking the views and evidence of the Islamic jurists and examining the reasons for the disagreement among them. In comparison, the analytical and comparative methods are used to discuss and analyze the opinions of the jurists and their evidence and compare these provisions with what is being practiced in Malaysian law. This study has reached some important results among others: the child of al-li`an remains a legitimate child as long as the father did not deny his lineage. The final decision on denying or confirming child’s lineage is based on the analysis of the genetic fingerprint (DNA result). Therefore, the lineage of al-li’an child and his inheritance right remains valid or undeniable unless the analysis result of the genetic fingerprint conforms with the statement of the father who denied his child lineage through al-li`an (oath of condemnation). - Some of the metrics are blocked by yourconsent settings
Publication The Concept of Islamic State in the Thought of Rasheed Rida through al Manar: Ottoman Caliphate as Model(Universiti Sains Islam Malaysia, 2018) ;Abdoul Karim Toure ;Mualimin Mochammad SahidShumsudin YabiThis study is an attempt to know the view of Rashid Rida through his book Al Manar about the concept of Islamic State. The Islamic State passed through a long and different stages from the Prophetic era, the four Caliphates, the two Dynasties Umayyad and Abbasid and the Ottoman Caliphate before its collapse. This long mix stages between strengths and weaknesses ended by the collapse of Ottoman Caliphate. Rashid Rida, tried hard to save in his capacity the Ottoman Caliphate but failed, he then indirectly describe it in many occasions with some descriptions which show that he was not satisfied with the State for some political and social reasons. The method upon which the study is based is inductive method. The researchers elaborated in the study the concept of Islamic state from Rashid Rida perspective from his Tafsir al- Manar. And among the findings of the study is that, as a scholar we should know that unity of the state is the solid ground of the implimentation of the rule of Allah, therefore it should always be the priority of the time. - Some of the metrics are blocked by yourconsent settings
Publication Constitutionalizing Sharia: Identity and Independence of Islamic Politics among Students(Fakultas Syari'ah IAIN Batusangkar, 2022) ;Khamami Zada ;Mundzeir Suparta ;Bambang Ruswadi ;Harapandi DahriMualimin Mochammad SahidThe emergence of Islamic political aspirations in Indonesia always occurs along with the development of national politics. It is delivered not only by Islamic elites from Islamic parties and Islamic movements but also by university students. This study explores the Islamic political aspirations of Islamic High School (STAI) students with a focus on the basic issues of the state, Islamic law, political system (democracy/Islamic caliphate), and the way to deliver the aspirations. This is quantitative research in which the data were collected through a representative survey in each province involving 222 university students in the fifth semester in the provincial capital, as the samples were allocated disproportionately to each selected university. This quantitative study was strengthened by qualitative data that were extracted by interviewing the directors of STAI in Padang, Semarang, Jambi, Kupang, Banjarbaru, and Samarinda. The findings of this study showed that Islamic political aspiration among university students was about the aspiration to implement Islamic law as state law in the Islamic caliphate system. The university students did not want democracy as a political system that implements Islamic law. These Islamic political aspirations are not delivered through violence but are expressed constitutionally. This Islamic political aspiration is built by integralistic/conservative religious identity and political independence/autonomy of university students. - Some of the metrics are blocked by yourconsent settings

This is done by stating several things, including: Analyzing halal practice standards in ASEAN countries, Aligning halal standards between ASEAN and developing AQRF on halal management. This study uses a qualitative method. The philosophical world view in this study is more attached to a pragmatic world view, this world view is based on applications and solutions to existing problems (Patton in Cresswell, 1990). From the point of view of research design, the researcher uses a case study design, the researcher develops an in-depth analysis of a case, program, event, activity, or process in one or more individuals. In the case study design approach, the researcher limits time and activities. Information collection is carried out by various data collection procedures. Data collection techniques used in this study are; 1. Interviews, 2. Content-relevant analysis of documents, 3. Round table. Based on the results that have been obtained that Indonesia has the ability to carry out production procedures that are guaranteed halal from each process. However, a thorough halal audit needs to be carried out consistently. Mahat ;Mualimin Mochammad Sahid ;Hasnizam HashimMuhamad darwisy mohd razaliAccidents have been unavoidable throughout the ages. It can happen to anyone unexpectedly, whether by negligence or not. Accidents usually bring losses to the victim, especially if they lead to injury or death. Islam, as a religion of revelation, provides a unique accident compensation mechanism called diat. It is conceptually a comprehensive and unprejudiced accident compensation system characterised by punishment and compensation. Punishment applies to the offender, and compensation applies to the victim. Understanding the concept of diat is critical, especially in acknowledging the social responsibility outlined by Islam in its execution process. This paper intends to examine the concept and development of the time-tracking system and discuss the implementation model of this system in modern life, especially in Malaysia. The data obtained was based on a qualitative study through document analysis, expert interviews and observation. The researcher analysed data descriptively and comparatively. The implementation model described is conceptual because it has yet to be practised in the modern world. The study results established that this system is efficient in contemporary society and complies with the principle of justice. Accordingly, the researcher recommends that the government, as a regulator, specify a particular body (diat committee) that will manage matters related to compensation and introduce diat takaful insurance. This research aimed to obtain data about Arabic pronunciation errors in students at junior high school. The research approach is qualitative. The sample of this study was 30 students of the Al-Mahmud IT Junior High School in Bima, Indonesia which were selected by using a simple random sample technique. The data of this research were the results of the students' audiovisual recordings when reciting Arabic text. Data analysis used the analysis model of Tarigan's, namely; data collection, identification, description, explanation, classification and evaluation. The results of this study The causes of phoneme errors are: environment, interference and performance. Classification of errors consist of omission, adding mad and Substitution. Through its teachings and values, Islam appears as a religion that propagates universal message of mercy and peace for all mankind regardless their race, colour and religion. Shariah as a law containing all guidance for Muslims in their daily life must be put above everything. However, challenges faced by Islam in different parts of the world have been occurring until today such secularism, liberalism, and other concepts and thoughts. This paper aims at explaining how Shariah can be guarded from the threat of liberalism which occurred in Indonesia through the movement called Jaringan Islam Liberal (Liberal Islam Network, abbreviated as JIL). The paper elaborates in details main issues related to the network which include among others: history its emergence, key figures, concepts and activities, as well as its missions and agenda. Based on qualitative method of research using library research referring to primary and secondary resources gathered, the paper analyse the concept and thoughts followed and disseminated by the Liberal Islam Network followers and further study their movement in order to expose the faults and deviations as portrayed by this movement which emerged for the first time in early 2001. Among the results of the research are as follow: The Liberal Islam Network (JIL) was a result of Modernity and its philosophical thought which influenced young Indonesian Muslims. It is funded by Western foundations and disseminates the ideas of Secularization, Westernization, Pluralism, Inclusivism, and Feminism, and Liberalism. This research aims to study the ruling on the felony of murder by transmitting Coronavirus (Covid-19) infection. Subsequently, the impact of inheritance and wills due to transmitting this infection deliberately or unintentionally. The research uses the descriptive approach and the analytical method in defining the felony of incapacitating murder and analyzing the impact of transmitting infection with this pandemic virus. The research comes with several results, including that whoever deliberately transmits infection with the Coronavirus (Covid-19) to people is regarded as the Spoilers on the land, that this felony deserves the punishment, that he is forbidden from inheriting if he is the heir, and that he is forbidden from the approval of the will if it is bequeathed to him. - Some of the metrics are blocked by yourconsent settings
Publication Imam Ar-Rafii Dan Peranannya Dalam Perkembangan Mazhab Syafii(UNISSA, Brunei, 2019) ;Abd Rahman Bin RahuniMualimin Mochammad SahidMazhab Syafi’i telah mengalami perkembangan yang pesat sejak beberapa kurun ke belakang. Ia telah mengalami beberapa fasa sebelum sampai ke tahap kukuh dan memiliki pendapat yang muktamad. Selepas kewafatan imam asy-Syafi’i mazhab tersebut telah dipacu kegemilangannya oleh dua orang tokoh besar yang datang empat kurun selepas kewafatan pengasasnya yang digelar sebagai syaikhain iaitu imam ar-Rafi’i dan an-Nawawi. Usaha ini dipelopori oleh imam ar-Rafi’i yang kemudiannya disambung legasi ini oleh imam an-Nawawi. Menerusi penelitian menunjukkan bahawa usaha yanag telah digembleng oleh imam ar-Rafi’i adalah sebuah usaha yang sangat besar nilainya di dalam perkembangan mazhab melalui pemurnian mazhab, pembetulan qaul muktamad dan pembersihan daripada pendapat syaz (tidak masyhur). Natijahnya dimanfaatkan oleh ulama sepanjang zaman sehingga ke dewasa ini dengan mengambil kira pendapat yang muktamad di dalam mazhab Syafi’i ialah pendapat yang dipersetujui oleh syaikhain atau salah seorang daripada mereka jika berlaku perbezaan pendapat antara mereka berdua. Hasil kajian menunjukkan bahawa beliau berperanan membetulkan semula penukilan ulama Syafi’iyyah terdahulu seperti qaulain daripada wajhain, membetulkan semula pandangan kebanyakan ulama mazhab yang memilih pendapat yang berbeza dengan pendapat yang muktamad, dan meluruskan semula sangkaan bahawa terdapat khilaf pada suatu masalah sedangkan hakikatnya tidak terdapat perselisihan di kalangan ulama mazhab. Selain itu beliau juga menggunakan istilah yang lain ketika memilih suatu pendapat seperti aqrab (lebih dekat kepada kebenaran) walaupun pada kebiasaannya menggunakan istilah asah (lebih kuat), sahih (kuat), azhar (lebih jelas dan kuat) dan masyhur (popular). - Some of the metrics are blocked by yourconsent settings

This is because the reality of the situation indicates the existence of a real crisis in the widening housing finance and engineering projects. It is worthpaying attention in this regard that there are additional and complex issues related to the use of adulterated substances in the field of engineering constructions and buildings, and this is harmful, and Allah SWT has prohibited this through His religion and provided guidelines to avoid the harms before they occur.Parts of these guidelines are the moral aspect of the religion, which prohibit someone to commit fraud. To explain the aforementioned further, the aims that this paper seeks to highlight is finding solutions This study aims at empowering people with special needs in society through incentive programs and development frameworks, supported by humanitarian organisations. These organisations will develop their skills and make them look forward to the best and rely on themselves on par with the other community members who sometimes ignore them. The research will show the importance of this group in society and their different characteristics from normal individuals until people have started to call them the term people with special needs. The problem of the study will clarify the injustice that befalls on them and the negative view of normal individuals towards them because of their disabilities. The study adopts descriptive and analytical approach and collects data related to the topic to analyse it and reach a conclusion. Among the most important findings of the study are the positive solutions and proposals that are reached to, i.e., limiting the bad perception of people towards this category of people with multiple talents and needs from society and officials. The study reached several results, namely: according to Islam, inherited defects in human body shall not be a reason to demean or belittle them, and people with this defect shall be given full right without demeaning or discriminating against them. Publication Implementation of HOTS in debate strategy to improve the ability of speaking Arabic among students(Pennwell Corporation, 2020) ;Uril Bahruddin ;HalomoanMualimin Mochammad SahidTeaching Arabic as a second language in higher institutions to students who are non-Arabic speakers has been a challenge. Although different methods and strategies have been implemented in different places, the results remain same. The phenomenon of students who cannot speak Arabic actively is seen as a common problem in many universities. Among the reasons is that the lecturers have not been able to implement appropriate learning strategies in teaching foreign languages. This study aims to measure the effectiveness of the implementation of debate strategies in improving students’ Arabic speaking skills and critical thinking. This study uses a pre-experimental design to know the effectiveness of applying the debate strategy. Data collection uses instruments in the form of tests, observations and documentation, and the data are analyzed quantitatively. The results show that the application of the debate strategy can improve Arabic speaking skills and critical thinking of students with t-count > t-table (3.5 > 2.09) which means that the null hypothesis (H0) was rejected and the alternative hypothesis (Ha) was accepted. Thus the application of HOTS in the Arabic debate strategy can improve students' speaking skills and critical thinking. Publication Implementation Of The Islamic Law Transformations' Rule (Taghayyur Ahkam) DuringG Covid-19 Pandemic In The Perspective Of Majelis Tarjih MUujammadiyyah In Indonesia(USIM Press, 2022) ;Fajar Rachmadhani ;Mualimin Mochammad SahidAhmad Wifaq MokhtarThe study entitled " Implementation Of The Islamic Law Transformation’s Rule (Taghayyur Ahkām) During Covid-19 Pandemic In The Perspective Of Majelis Tarjih Muhammadiyah In Indonesia" aims to uncover and analyze one of the methods and rules of law-making (istinbāth ahkām) carried out by the Muhammadiyah fatwa institution, the Majelis Tarjih dan Tajdid, or known as "Manhaj Tarjih Muhammadiyah." One of the many methods used by Majelis Tarjih in issuing legal decisions and fatwas is the Rules of Islamic Law Transformation (taghayyur ahkām). The research also attempts to contextualize the rules of Islamic law transformation with the decisions or guidelines for the implementation of worship (Ibadah) that have been issued by the Muhammadiyah Central Leadership through the Majelis Tarjih, especially during the current Covid-19 pandemic. The results of this study are beneficial both practically and theoretically. The practical benefit of this research is that it may provide guidelines for the implementation of worship during the Covid-19 pandemic based on argumentative arguments and the principles and objectives of Islamic law, one of which is guarding religion (Hifz ad-Dīn) and guarding human lives (Hifz an-Nafs). Meanwhile, the theoretical benefits from this research are to expand the knowledge and discourse of Islamic scholarship, especially in the field of Islamic law. Thus, Islam can manifest in the midst of mankind to provide real solutions to existing problems. This research uses qualitative research focusing on library research with descriptive analysis. Consequently, the researchers applied the Ijtihād of Majelis Tarjih’s Method known as "Manhaj Tarjih Muhammadiyah" written by Syamsul Anwar as well as based on the results of the Tarjih National Assembly (Munas) XXX in Makassar in 2018, also the decision of the Muhammadiyah Central Leadership No. 02/EDR/1.0/E/2020 regarding Guidelines for Worship in Covid-19 Emergency conditions and several other Tarjih fatwas related to guidelines for carrying out worship during the Covid-19 pandemic as primary data. In addition, the secondary data are from various sources, such as fiqh books, ushul fiqh, and maqaṣid as-syarī'ah. Publication Integrating Islamic Ruling And The Medical Concept: A Study Of The Hermaphrodite Inheritance(Universiti Sultan Azlan Shah (USAS), Perak, MALAYSIA, 2022) ;Raouane Azziz ;Ruhi Fadzlyana JailaniMualimin Mochammad SahidDetermining the gender of the heirs is important in the ruling of Islamic inheritance. Hence, Muslim jurists made efforts in determining the gender of hermaphrodites. Taking the safer position, the common practice is for the inheritance to be divided into two: the greater part of the share is withheld and the lesser portion is given out to the hermaphroditic inheritors along with their heirs until their gender is certified. This typically leads to disagreements among the jurists, hence, subsequently leading to a tedious process of certification. This protracted disagreement combined with a much prolonged certification process may harm the inheritors’ right due to the delay in judgement. This research aims to define the biological identity of a hermaphrodite and determine his sex according to the medical concept, as well as integrating the methods adopted by Muslim scholars to solve the issue of hermaphrodite inheritance. Both descriptive and analytical approaches are used in ensuring accurate knowledge transfer and trust in attribution. This research has found that the medical definition of a hermaphrodite is the most accurate and the most correct to end the dispute when dividing inheritance. Hence, this opens a wider area for further research that relies on medical information as evidence to be taken when studying Islamic legal rulings in ensuring the cohesion of society by preserving the rights of its members and maintaining their material and moral properties. - Some of the metrics are blocked by yourconsent settings

From the conducted studies, several conclusions can be drawn. First, the Judge's legal considerations in canceling the minimum age of marriage in decision No. 22/PUU-XV/2017 are based on consideration of discrimination acts, health and educational aspects, child exploitation, the minimum age requirement for marriage in various countries, and policy demands related to marriage age. Second, in terms of the al-Bûṯî’s maslaẖah theory, the Constitutional Court's ruling on the equalization of marital age between men and women is not categorized as a maslahah, since it does not meet the five criteria for something to be called as a maslahah. Third, according to the gender equality theory in Islam, it can be concluded that the Constitutional Court's decision is not suitable to the theory, since the meaning of equality in Islam is not to be equal but rather to the fulfillment of rights according to the level of needs. - Some of the metrics are blocked by yourconsent settings

The Syariah and Civil courts in Malaysia practiced in the different structures, procedures, and jurisdictions as Malaysia practiced a dual system of law. Therefore, this article aims to identify the justification of punishment practiced by both courts in sentencing the child offenders in Malaysia. There are nine sources have been used as a database in screening the past research articles starting from years of 2010 until 2021. The systematic literature review consists of search strategies, study collection, data collection, and analysis for the articles obtained. A sum of 18 articles was assessed for eligibility through criteria such as year of publication, languages, and has met the required elements. This article indicates that both courts tend to impose a punishment consisting of rehabilitative methods to protect the best interest of the children. Dalam adat perpatih yang diamalkan sehingga ke hari ini, pusaka ini dianggap sebagai harta milik seluruh ahli keluarga yang diwariskan secara turun temurun melalui pihak perempuan (garis keturunan ibu). Berdasarkan kepada hukum warisan Islam (faraidh), amalan adat perpatih dalam pembahagian harta pusaka tinggi (tanah adat/ulayat) ini dilihat bercanggah dengan hukum yang telah ditetapkan dalam Islam. Walaubagaimanapun, terdapat perbezaan pandangan dalam menerima amalan ini di kalangan masyarakat. Ada yang menerimanya sebagai satu amalan yang berdasarkan kepada pendekatan hukum wakaf keluarga (waqaf dzurri) dan ada juga yang menentangnya serta menganggapnya sebagai satu amalan yang bercanggah dengan hukum Islam dalam pembahagian warisan (faraidh). Menerusi kajian literatur dengan menggunakan kaedah perbandingan di antara hukum adat dan hukum syariah, kertas kerja ini akan membentangkan isu-isu berkaitan tanah adat sebagai harta pusaka yang diamalkan dalam adat perpatih. Selanjutnya mencadangkan pendekatan syarak dan jalan keluar (solusi) bagi ketidakjelasan hukum dalam amalan warisan pusaka tinggi (tanah adat/ulayat) disebabkan perbezaan pandangan di antara golongan yang tidak bersepakat adakah ia dilarang ataupun dibenarkan dalam syarak. Hasil kajian mendapati bahawa jalan tengah yang boleh diambil dalam menyelesaikan isu hukum amalan warisan tanah adat ini adalah menerusi pendekatan wakaf keluarga (dzurri) dengan cara menjadikan pihak perempuan yang mewarisi harta tersebut hanya sebagai pemegang amanah. Oleh itu, status tanah tersebut adalah harta wakaf yang boleh dimanfaatkan oleh semua pihak keluarga namun tidak boleh diperjualbelikan.
